Proposal to amend regulations on determining the age of ships

The Ministry of Transport is seeking comments on the draft Decree amending and supplementing a number of articles of Decree 171/2016 regulating the registration, deregistration, purchase, sale and construction of new ships and Decree 86/2020 amending and supplementing a number of articles of Decree 171/2016.

Changing regulations on determining the age of ships is one of the notable points put forward in the draft.

The proposed age of the ship is calculated from the delivery date - the time when the ship is completed and can be put into use (Illustration photo).

According to current regulations, the age of a ship is calculated in years and starts from the date the ship's keel is laid.

In case the date of laying the main keel cannot be determined, it shall be calculated from the date when the hull assembly reaches 50 tons in mass or equal to 1% of the total estimated mass of the materials used to make the hull, whichever is smaller.

In the draft being consulted, the age of ships is proposed to be revised in years and starting from the date of handover.

According to the Ministry of Transport, according to the regulations of each country, the age of a ship can be calculated from the date of laying the keel, the date of launching, and the date of handover. Currently, some countries such as Korea and Japan determine the age of a ship based on the date of handover.

The regulation that the age of a ship is calculated from the "date of delivery" shows that the age of the ship is calculated from the time it is completed and can be put into operation. This will be consistent with the regulation on calculating the age of inland waterway vehicles in Decree No. 111/2014 regulating the age of inland waterway vehicles.

The proposed amendment to this regulation is assessed as consistent with a number of requirements and tasks in Resolution No. 58 of the Government on a number of key policies and solutions to support businesses in proactively adapting, recovering quickly and developing sustainably by 2025.

"The amendment of the content related to the method of determining the age of a ship based on the "delivery date" contributes to promoting maritime transport enterprises to equip ships suitable for their finances and operating capacity, increasing the total GRT tonnage of the national fleet.

This is also a solution to contribute to increasing the market share of domestic shipping fleets, reducing dependence on import and export goods transport by sea of ​​foreign shipping lines," the Ministry of Transport said.
