The Ministry of National Defense proposes that operators of drones and ultra-light flying vehicles such as flycams must be 18 years old and trained and certified.
The Ministry of Justice is reviewing the draft Law on People's Air Defense, drafted by the Ministry of National Defense. The draft law stipulates principles and policies for managing the operation of unmanned aircraft, ultralight aircraft, and ensuring air defense safety.
According to current regulations, only people over 18 years old have full civil capacity. However, Decree No. 36/2008 on the management of unmanned aircraft and ultralight aircraft does not have specific regulations on the age and qualifications of the vehicle operators.
Organizations and individuals organizing flight activities must submit a license application including an application; technical documents on the aircraft, including photos and a description of technical features; a license or legal authorization allowing the aircraft or aircraft to take off and land at airports, areas on land or water.

The Ministry of Defense said that high-tech weapons are currently being researched and designed with a leap in quality and technical and tactical features. Among them, unmanned aircraft, ultra-light aircraft, and UAVs are increasingly being used widely, changing traditional combat methods. Some countries are researching UAVs for use in military operations to conduct war with flexibility and high destructive capacity.
In Vietnam, the exploitation and use of unmanned aerial vehicles is becoming more and more popular and diverse. Violations tend to be complicated, threatening national defense, security, and aviation safety. Therefore, the Ministry of National Defense believes that it is necessary to soon build a strong people's air defense force; capable of observing and detecting early and from a distance.
"The promulgation of the Law on People's Air Defense is an inevitable, objective and urgent requirement; responding to the practical cause of building and protecting the Fatherland in the new situation," the Ministry of National Defense stated.
Unmanned aerial vehicles are flying devices that do not require direct control by a pilot or flight crew. Ultralight aircraft include flycams (remotely controlled flying vehicles with cameras); unmanned balloons and motorized flying models controlled by radio or pre-programmed programs.
The Ministry of National Defense proposes that competent authorities of the police, army, and airports be allowed to suspend unmanned aerial vehicles in cases where the flight time, altitude, distance, or area of the flight license are not in accordance with the flight permit; the aircraft has not been registered, licensed, or expired; the pilot does not have a certificate; and the aircraft is used in a manner inconsistent with the original registration.
Unmanned aerial vehicles are suppressed and confiscated when flying without a license; flying into restricted areas; violating the area of airports, airfields or surrounding areas; operating for the purpose of propaganda, incitement, sabotage against the Party and State and violating the law; carrying flammable substances, explosives, explosives, biological weapons or prohibited substances.
