Proposed prohibited behaviors for teachers

The Ministry of Education and Training has just announced the draft Law on Teachers (3rd time) to collect public opinions. The project will be submitted to the National Assembly for consideration and initial comments at the 8th session (October 2024) and considered and approved at the 9th session (May 2025).

One of the notable contents in the draft law is prohibited acts against teachers and prohibited acts against other individuals and organizations.

According to Article 13 of the draft, the Ministry of Education and Training proposes to strictly prohibit teachers from committing the following acts: Insulting the dignity, honor, and body of students, colleagues, and people; Discriminating between students in any form; Cheating, intentionally distorting results in enrollment, testing, exams, and student assessment activities;

Distorting educational content; taking advantage of teaching and educational activities to propagate content contrary to the Party's guidelines and viewpoints, the State's policies and laws, propagating hostile policies, causing division in the great national unity bloc;

Forcing students to participate in extra classes in any form, paying amounts of money outside of the law; Taking advantage of the title of teacher and teaching and educational activities to commit illegal acts; allowing others to use teaching licenses in any form; Arbitrarily quitting jobs, participating in illegal strikes; Violating teachers' ethics and other prohibited acts according to the law.

In addition, to protect teachers, the Ministry of Education and Training also proposed prohibited acts for organizations and individuals with the following behaviors: It is strictly forbidden to insult the honor, dignity, and violate the body of teachers; Obstruct the professional activities of teachers; Assign teachers not in accordance with the agreement and commitment in the teaching contract; Discriminate between teachers in any form; Pay salaries not in accordance with the contract; Failure to fully and promptly implement the regime and policies for teachers according to regulations;

Disclose information about teachers' violations when there is no official conclusion from a competent authority during the process of considering discipline or prosecuting the teacher's legal responsibility and in cases where the violations are not serious enough to require revocation of the teaching license.

Thus, the Draft Law on Teachers mentions prohibited acts for organizations and individuals in their relations with teachers. There are 6 prohibited acts ranging from insulting the honor and dignity of teachers to discriminating between them. This provision also demonstrates the law's commitment to ensuring teachers and creating a positive and fair working environment for teachers.

Commenting on the draft Law on Teachers, Associate Professor Dr. Tran Thanh Nam - Vice Principal of the University of Education, Vietnam National University, Hanoi said that in order to enhance the status of teachers, it is necessary to have stricter regulations on prohibited acts of organizations and individuals against teachers.

Accordingly, not only is the act of "insulting the honor, dignity, and violating the body of teachers" strictly prohibited, but also all other forms of psychological pressure and manipulation; for example, not cooperating, not cooperating, or creating a hostile, fearful environment...

In addition, even when the case has been concluded, it is necessary to inform carefully, without revealing or publicly disclosing the exact identity so that the individual may no longer meet the standards to be a teacher but still have the opportunity to work in another profession.
