National Assembly Delegate: Do individuals who volunteer to rescue people in case of fire have to register with the commune police?

Fire rescue does not require registration

On the morning of November 1, discussing the draft Law on Fire Prevention, Fire Fighting and Rescue, delegate Nguyen Van Manh (Vinh Phuc) proposed to review the definition of accidents and incidents.

The delegate proposed to review and revise: "Accident, incident is an event caused by nature, humans, animals that threatens or causes damage to human life, health, property of agencies, organizations, individuals that need to be rescued" for easier understanding and in accordance with reality. This is also the current regulation in use in Clause 3, Article 3, Decree No. 83/2017/ND-CP on rescue work of fire prevention and fighting forces.

Regarding fire prevention, fire fighting, rescue and volunteer rescue, delegate Nguyen Van Manh said that in Clause 2, Article 39 stipulates: "Individuals who wish to participate in fire prevention, fire fighting, rescue and volunteer rescue activities must register with the police at the commune level where they reside for mobilization when required."

Delegates asked whether volunteers who participate in rescue and firefighting must register with the police or not. In reality, many people volunteer to participate in rescue in emergency situations to save people and limit casualties when there are no authorities.

The delegate gave an example of a young man who saved several people in a fire at a motel in Trung Kinh (Cau Giay, Hanoi) or people who participated in extinguishing the fire and rescuing people in a series of accidents at Phu My Bridge (Thu Duc, Ho Chi Minh City) in August when authorities had not yet arrived at the scene.

Therefore, the delegate proposed to add the phrase "except for volunteer fire prevention and rescue in emergency situations" at the end of the above clause.

Regarding fire reporting, situations requiring rescue (Article 6), delegate Nguyen Van Manh proposed considering adding a provision stipulating that the People's Committee at the commune level is responsible for informing about the list of agencies and organizations belonging to the fire prevention, firefighting and rescue forces, and the police agency in the commune, along with hotline numbers and contact addresses so that people know and choose the nearest place to report fires, rescue and rescue in case of need.

Expressing his views on some controversial contents of the draft Law on Fire Prevention, Fire Fighting and Rescue, delegate Vu Hong Luyen (National Assembly delegation of Hung Yen province) proposed adding fire prevention for high-rise apartment buildings.

According to delegate Vu Hong Luyen, high-rise apartments are densely populated areas with high risk of fire and explosion. Many high-rise apartments were built a long time ago, and during use, the technical system was damaged or repaired, leading to the work of fire prevention, fire fighting, rescue and relief no longer being guaranteed.

With the above argument, delegate Vu Hong Luyen said that there should be regulations on the traffic system leading to high-rise apartment buildings to ensure that at least specialized fire prevention, firefighting, rescue and emergency vehicles can access when a fire or explosion occurs to minimize damage to people and property.

In addition, the delegate said that escape skills play a particularly important role for people in any fire. In order to protect themselves and those around them, reduce casualties, and coordinate well with rescue forces when a fire or explosion occurs, delegate Vu Hong Luyen suggested that the drafting agency study and supplement more detailed and specific regulations on escape skills.

Accordingly, the responsibilities of trained and fostered subjects in fire prevention, fire fighting, rescue and first aid as prescribed in Clause 1, Article 45 of the draft Law are supplemented in regular training, fostering and practicing for grassroots levels, hamlets, villages, residential groups and households. This is done so that escape skills do not stop at equipping theory and knowledge but must become a natural reflex of each citizen when any fire or explosion, big or small, occurs.
