On December 27, the Ho Chi Minh City People's Court held a first-instance trial of a case of violating bidding regulations and lack of responsibility causing serious consequences at the Tay Ninh Provincial Department of Health. Accordingly, defendant Hoa Cong Hau (61 years old, former Director of the Tay Ninh Provincial Department of Health) was prosecuted for "violating bidding regulations causing serious consequences".

The defendants prosecuted for the same crime include: Le Thanh Lu (former Deputy Head of the General Planning Department of the Department of Health), Hoang Thi Thuy Nga (Chairwoman of the Board of Directors of NSJ Company) and 8 other defendants holding leadership positions at NSJ Company and Nam Sai Gon Consulting and Investment Joint Stock Company.
In connection with the case, Dang Thi My Nga (former Head of Price and Public Asset Management Department of Tay Ninh Province's Department of Finance) and Vu Thi Thu Nga (former specialist of Tay Ninh Province's Department of Finance) were prosecuted for "lack of responsibility causing serious consequences".
The trial was presided over by Judge Huynh Van Truc. Representatives of the Ho Chi Minh City People's Procuracy attending the trial were Ms. Nguyen Thi Hong Van, Mr. Nguyen Dinh Hoi and Mr. Mai Hoang Dong.
The victim in the case was identified as the Department of Health of Tay Ninh province. The People's Committee of Tay Ninh province and the General Hospital of Tay Ninh province were summoned as people with related rights and obligations.
The trial is expected to last 3 days (December 27-29).
From the morning of December 27, as the first person to answer the People's Court, the former Director of the Department of Health of Tay Ninh province declared his criminal record. Defendant Hau has been detained since May 17, 2022 until now.
Defendant Vu Thi Thu Nga also confirmed that she is serving a 30-year prison sentence in three cases sentenced by the People's Courts in Ho Chi Minh City, Quang Ninh and Hanoi.
Responding to the panel of judges, the remaining defendants also confirmed their criminal records as announced by the panel of judges at the beginning of the trial.

According to the indictment, Mr. Hau, when he was the Director of the Tay Ninh Department of Health, directed and directly signed documents requesting purchase policies and organizing bidding to buy CT scanners for the Provincial General Hospital. Mr. Hau is the person responsible before the law during the bidding process to select contractors.
The indictment determined that Hau knew that Nga had relationships with many leaders and had won many bids for medical equipment packages in the provinces, so when she asked for help, he agreed. After that, Mr. Hau directed Mr. Lu to have NSJ Company introduce the 128-slice CT-Scanner system and agreed to buy the system for 28 billion VND as requested by Ms. Nga.
Mr. Hau directed Mr. Lu to advise him to sign a document to send to the People's Committee of Tay Ninh province to designate the purchase of a 128-slice CT-Scanner system, of which the Russian NSJ Company is the official distributor in Tay Ninh province. During the process of preparing the bidding documents, the director of the Tay Ninh Department of Health directed his subordinates to process the documents to create an advantage for NSJ Company to win the bid.
After Mr. Hau agreed to help, Ms. Nga directed her staff to approach the Department of Health to persuade them to choose the equipment provided by her company; prepare bidding documents on behalf of many participating "blue team" companies. The parties agreed to let NSJ Company win the bid.
The indictment stated that the value of the camera provided by NSJ Company was more than 14 billion VND, and the defendants' actions caused damage to state property of more than 13 billion VND.
ESTABLISHING A "BLUE TEAM" CONTRACTOR TO HELP NSJ COMPANY WIN THE BID
According to the indictment, from 2018 to 2020, after NSJ Company won the bid, on holidays and Tet, Mr. Hau received gifts worth 1 billion VND 3 times, and Mr. Lu received 600 million VND. Messrs. Hau and Lu returned the entire amount to remedy the consequences.
The indictment determined that Ms. Nga took advantage of her relationship with Mr. Hau, directing her subordinates to create "blue team" contractors to participate in the above bidding package in order to create conditions for NSJ Company to win the bid, illegally profiting more than 13 billion VND.

But Ms. Nga did not admit to giving gifts and money to the investor and related parties. Ms. Nga stated that the "blue team" contractors agreed to help NSJ Company out of respect and wanting to maintain the partnership, not to receive material benefits.
Ms. Nga was the Deputy General Director of AIC Company, then Chairwoman of the Founding Board of NSJ Group Company and established 7 companies under the legal name of her subordinates. Although the business licenses are for independent companies, in fact, Ms. Nga invested in the establishment and managed all activities.
On January 4, Hoang Thi Thuy Nga was sentenced to 12 years in prison by the Hanoi People's Court for "violating bidding regulations causing serious consequences" in a case that occurred at Dong Nai General Hospital.
On February 17, with the same charge, Ms. Nga continued to be sentenced to 8 years in prison by the Ho Chi Minh City People's Court in the first instance trial in the case that occurred at the Can Tho City Department of Health.
In addition, Ms. Nga was also accused of violations in bidding for educational equipment in Quang Ninh province, causing losses to the State of 80 billion VND.
