The Central Inspection Commission has just issued Instruction No. 15-HD/UBKTTW, amending and supplementing a number of contents in Instruction No. 05-HD/UBKTTW dated November 22, 2022 on implementing Regulation No. 69-QD/TW of the Politburo on disciplining party organizations and party members who violate the law.
According to Instruction 15-HD/UBKTTW, points 8.1 and 8.2, section III in Instruction No. 05-HD/UBKTTW in 2022 on instructions for implementing a number of articles in the Regulations on disciplinary action against party organizations and party members who violate the law have been officially removed. These are the points regulating the consideration and disciplinary action against violations of population policy, including having a third child.
At the same time, the new guidance adds point 8.3 as follows: "Do not consider handling the behavior specified in Clause 2, Article 1 of Ordinance No. 08/2008/PL-UBTVQH12 dated December 27, 2008 amending Article 10 of the 2003 Population Ordinance "Giving birth to one or two children, except in special cases prescribed by the Government".
Thus, from March 20, 2025, having a third child is no longer considered a violation for Party disciplinary action. Therefore, Party members who have a third child will no longer be subject to disciplinary action.
Previously, at the meeting on February 14, the Politburo considered the proposal of the Central Inspection Commission on reviewing Party regulations related to handling violations of population policy, and the report of the Party Executive Committee of the Health Department on 7 years of implementing Resolution 21 of the 12th Central Committee.
The Politburo basically agreed with the content and recommendations and proposals stated in the report evaluating the 7-year implementation of Resolution 21 and the results of the review of Party regulations related to handling violations of population policy.
The Politburo assigned the Central Inspection Commission to advise and amend the regulations of the Central Executive Committee, the Politburo, and the Secretariat related to handling violations of population policy and proactively amend Instruction No. 05/2022 of the Central Inspection Commission in the direction of not subjecting disciplinary action in cases of giving birth to a third child or more, in line with amending legal provisions (not retroactively handling cases that have been disciplined).
