Continuing the 9th Extraordinary Session of the 15th National Assembly, on the morning of February 12, Group 18, including the National Assembly Delegation of Thanh Hoa Province, the National Assembly Delegation of Ha Nam Province and the National Assembly Delegation of Tra Vinh Province, discussed in groups the draft Law on amending and supplementing a number of articles of the Law on Organization of the National Assembly and the draft Law on Promulgation of Legal Documents (amended).

The draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly focuses on the following contents: Amending and supplementing regulations on the People's Council and Committees of the National Assembly; amending and supplementing regulations on the Secretary General of the National Assembly, the Office of the National Assembly, and agencies under the Standing Committee of the National Assembly; adjusting a number of contents related to the division of authority between the National Assembly and the Standing Committee of the National Assembly and the authority of the Government and other state agencies; at the same time, combining amendments and supplements to a number of articles and clauses related to the activities of the National Assembly, the Standing Committee of the National Assembly, agencies of the National Assembly and National Assembly deputies, which, through a summary of practical activities from 2016 to present, have encountered difficulties and inadequacies.

At the same time, they said that the amendment and supplement of the law ensures flexibility in the organization and operation of the National Assembly, promptly institutionalizing the policies agreed upon by the Politburo and the Central Executive Committee in conjunction with the requirements of legislative work, supervision and especially deciding on important issues in the new situation.

Participating in giving comments on Article 5 on law making and law amendment, National Assembly Deputy Mai Van Hai, Provincial Party Committee member, Deputy Head of the National Assembly Delegation of Thanh Hoa province, said that this is a very important content in the activities of the National Assembly. In particular, Point 2, Clause 2 stipulates a number of issues of long-term stability and specific regulations on contents related to human rights. According to the delegate, it is more appropriate to stipulate them in the Law on legal documents; at the same time, it is also necessary to review and remove contents of the Party's orientation and policies.

There should be principled and specific regulations on voting and voting for confidence in positions elected or approved by the National Assembly. Participating in giving comments on Clause 4, Article 5 regulating the authority of the National Assembly, National Assembly Deputy Cam Thi Man said that Clause 4 stipulates that the law-making for each term is determined and implemented according to the legislative orientation of the National Assembly's term and the annual legislative program. Accordingly, it is proposed to replace the phrase "law-making" with the phrase "legislative work" to ensure the correct authority of the National Assembly as prescribed in Article 69 of the Constitution, which is that the National Assembly exercises the right to make the Constitution, the right to legislate, decide on important issues of the country and exercise supreme supervision over the activities of the State.

Participating in giving opinions on the organizational structure of the National Assembly's Ethnic Council and Committees, National Assembly Deputy Cam Thi Man said that Clause 1, Article 67, after being amended, is stipulated as follows: The National Assembly's Ethnic Council consists of a chairman, vice chairmen and members; the National Assembly's Committees consist of a chairman, vice chairmen and members. Currently, part-time delegates or full-time delegates in localities all register to become members of the National Assembly's Ethnic Council or members of committees. If according to this provision, do part-time delegates and full-time delegates in localities belong to the organizational structure of the National Assembly's Ethnic Council or Committees?

National Assembly Deputy Cam Thi Man agreed with the draft that there is no provision for permanent members and full-time members as in the current law. However, to clarify the organizational structure of the Ethnic Council, the National Assembly Committee proposed to define members as follows: Permanent members are permanent members and full-time members at the Central level as prescribed by current law and non-permanent members are full-time delegates at the local level and non-permanent delegates (part-time delegates). Accordingly, it is proposed to amend Clause 1, Article 67 to: The Ethnic Council consists of a chairman, vice chairmen, permanent members and non-permanent members; the National Assembly Committee consists of a chairman, vice chairmen, permanent members and non-permanent members. Or consider amending this provision in the Resolution of the National Assembly Standing Committee on the functions, tasks and powers of the Ethnic Council and the National Assembly Committee.

Participating in giving opinions on the draft Law on Promulgation of Legal Documents (amended), the National Assembly Deputies basically agreed with the amendment of the draft Law. At the same time, they said that the amendment of the draft Law aims to promptly institutionalize the Party's policy on innovation and improvement of the law-making process; contributing to speeding up the progress, improving the quality of the formulation and promulgation of legal documents, and perfecting the institution to meet the requirements of national construction and development in the new period.
