According to the meeting agenda, the Government will consider giving opinions and resolutions on 11 contents (6 draft laws, 4 proposals for law making, and proposals on the Law and Ordinance Making Program).

Specifically, the six draft laws discussed include: Draft Law on People's Air Defense; Draft Law on Management and Use of Weapons, Explosives and Supporting Tools (amended); Draft Law on Cultural Heritage (amended); Draft Law on Geology and Minerals; Draft Law on Amending and Supplementing a Number of Articles of the Law on Technical Standards and Regulations; Draft Law on Amending and Supplementing a Number of Articles of the Law on Pharmacy.

4 proposals for law making include: Proposal to make Law on Diplomatic Functions and Levels; Proposal to make Law on Aviation (amended); Proposal to make Law on Railways (amended); Proposal to make Law on Digital Technology Industry.

The Government also reviewed and commented on the proposal on the 2025 Law and Ordinance Development Program and adjusted the 2024 Law and Ordinance Development Program.

In his opening remarks at the meeting, Prime Minister Pham Minh Chinh reiterated that institutional building and improvement is one of the three strategic breakthroughs identified by our Party and State. In 2024, right from the first days of the year, we have been making efforts and urgently implementing synchronously and effectively tasks and solutions, in which institutional breakthroughs continue to be a key task.

In recent times, we have made many efforts and achieved many results in building and perfecting institutions, but there are regulations that have been surpassed by practice; many new areas are developing that require legal regulations to regulate. In January 2024, the Government held a thematic session on law making with 5 contents.

Prime Minister

The Prime Minister stated that the task in February is even more difficult, including actively preparing to submit to the National Assembly the Law and Ordinance Development Program for 2025, adjusted for 2024 (must be submitted to the National Assembly Standing Committee before March 1, 2024), and resolving draft laws to serve the 7th Session of the 15th National Assembly (May 2024).

According to the Prime Minister, the contents of the meeting are all important and difficult, with high requirements, while time and resources are limited. To ensure progress and improve quality, the Prime Minister requested that the presiding and drafting agencies, Ministers, heads of agencies must directly direct the development of draft laws, propose the development of laws, and relevant agencies must give timely opinions; arrange competent, qualified, and dedicated officials for the work of building and perfecting institutions; review the regime and policies to ensure suitability for officials doing this work with the view that investment in building institutions is investment in development.

The Prime Minister noted that during the process of drafting laws and proposals for law making, the opinions of relevant ministries, ministerial-level agencies, and government agencies will only be sought once. If there are still different opinions, the Deputy Prime Minister in charge will convene a meeting with the ministries and agencies to handle them immediately. At the same time, the Prime Minister requested that agencies prepare and promptly issue guiding documents for implementation immediately after the laws come into effect.

With the spirit of "resolving difficulties wherever there are, and resolving problems at whichever level", the Prime Minister requested that agencies continue to review and propose competent authorities to amend and supplement regulations, ensuring clarity, strictness, transparency, publicity, practicality, ease of understanding, ease of remembering, ease of implementation, ease of inspection, supervision, and evaluation, so that law enforcement and compliance subjects can feel secure in their implementation.

The Prime Minister emphasized that practice shows that if the work of drafting legal documents is well prepared, summarizing practice and forecasting the situation is done well, then the regulations and policies after being issued will immediately come into effect, solving difficulties and problems. However, if the preparation is not thorough or good, they will have to be revised and supplemented as soon as they are completed.

Speaking at the opening session of the meeting, on the occasion of the 69th anniversary of Vietnam Doctors' Day (February 27, 1955 - February 27, 2024), Prime Minister Pham Minh Chinh respectfully sent his thanks, greetings, best wishes and best wishes to the medical staff, cadres, civil servants, public employees and workers in the health sector; hoping that the medical staff, cadres, civil servants, public employees and workers in the health sector will continue to excellently fulfill their tasks of caring for and protecting the lives and health of the people with the motto of prevention is better than cure, well implementing President Ho Chi Minh's advice "Doctors are like kind mothers", meeting the expectations of the Party, State and people.

After listening to the discussion, Prime Minister Pham Minh Chinh gave his concluding comments on each content and assigned specific tasks to complete the draft laws and proposed the development of laws. In particular, with the draft Law amending and supplementing a number of articles of the Law on Pharmacy, the Prime Minister said that drugs are special goods, so there must be a special management policy, but it needs to be open on the basis of eliminating the mechanism of asking for and giving, complying with market rules, simplifying administrative procedures for establishments producing and trading drugs and medicinal materials, promoting decentralization, decentralization, and increasing recognition and assessment of conformity from advanced countries. The Prime Minister also noted the policy of encouraging investment attraction and development of the pharmaceutical industry.

Regarding the draft Law on Cultural Heritage (amended), the Prime Minister emphasized the need to preserve, embellish and promote the nation's cultural heritage, develop the cultural industry, promote investment and business in the field of cultural heritage, mobilize social resources through strengthening public-private cooperation; develop cultural human resources. The Prime Minister noted the need to carefully research, refer to international experience, and consult experts on regulations related to the business of treasures on the basis of management by tax tools. The Prime Minister also noted the need to encourage and have policies to manage the activities of private museums; the provisions of this law do not overlap with the Law on Archives...

Concluding the meeting, Prime Minister Pham Minh Chinh acknowledged and highly appreciated the efforts and active preparation of the ministries in charge, submitting projects and proposals for law making, seriously accepting and explaining the dedicated, responsible and in-depth opinions of the Government members and delegates at the meeting.

The Prime Minister requested that the Ministers direct the serious and complete acceptance of the opinions of the Government members, complete the draft laws, proposals for law making, proposals for the Law and Ordinance Making Program; the Deputy Prime Ministers pay attention to and directly direct the completion of projects and proposals as assigned; submit to competent authorities as prescribed.

Regarding the preparation of proposals for the 2025 Law and Ordinance Development Program and adjustments to the 2024 Law and Ordinance Development Program, the Prime Minister assigned the Ministry of Justice to preside over, coordinate, guide, and urge ministries and agencies to submit proposals for law development to the Government for consideration and approval; and synthesize and include them in the Government's proposal to the National Assembly.

Regarding the preparation of draft laws to be submitted to the National Assembly for consideration and comments at the upcoming 7th Session, the number of draft laws is very large, so the task is very heavy. The Prime Minister requested that Ministers and Heads of ministerial-level agencies focus resources, lead and direct the completion of draft laws according to regulations.

Regarding the two draft laws, including the draft Law on Notarization (amended) and the draft Law on Prevention and Combat of Human Trafficking (amended), which were approved by the Government at the January 2024 Legal Session, the Prime Minister assigned the Ministry of Justice and the Ministry of Public Security to preside over and coordinate with relevant ministries and agencies to complete the draft Law dossier to submit to the National Assembly Standing Committee within the deadline.

Regarding the draft Law on Urban and Rural Planning, the Prime Minister assigned the Ministry of Construction to urgently revise and complete the draft law dossier and submit it to competent authorities according to regulations. Noting a number of key points and requirements in building and perfecting institutions, the Prime Minister requested promoting the role of leaders, Ministers, and Heads of ministerial-level agencies directly leading and directing the work of building and perfecting institutions; focusing resources and having appropriate policies and regimes for cadres and civil servants working in legal affairs, especially the work of building and perfecting institutions; further shortening the process of amending and supplementing legal documents to meet practical requirements; continuing to refer to international experience, absorbing contents suitable to the conditions and circumstances of our country; strengthening policy communication, especially communication during the process of building and promulgating laws, creating consensus and effectiveness in the process of building, promulgating and enforcing laws.

Prime Minister Pham Minh Chinh emphasized the need to ensure progress and improve the quality of draft laws on the basis of closely following the Party's guidelines and policies, relevant State policies and laws, removing difficulties and obstacles in practice, handling issues that have been regulated but have been overcome in practice, and new issues that have not yet been regulated; enhancing policy response capacity; and ensuring processes and procedures are in accordance with regulations.

The Prime Minister noted that policies, regulations and expressions should be designed to ensure clarity, brevity, ease of understanding, ease of implementation, ease of inspection, supervision and evaluation; attention should be paid to listening to opinions of experts, scientists, practitioners, businesses and people; for issues with different opinions, specific plans should be designed, clearly stating viewpoints for competent authorities to consider and decide.

The Prime Minister especially emphasized the requirement to eliminate the request-grant mechanism to prevent and combat group interests, corruption, negativity, and violations; to minimize and simplify administrative procedures and business conditions, not to cause inconvenience, reduce costs and time for people and businesses; to promote decentralization and delegation of power along with appropriate resource allocation, improve implementation capacity, strengthen inspection and supervision; and to unleash all resources for development.
