It is necessary to strictly handle fraudulent acts of "charity banners" during flood season to maintain the trust of the community and the spirit of the rule of law.

The fact that the Central Committee of the Vietnam Fatherland Front (VFF) has continuously posted thousands of pages of statements of donations to people affected by storm No. 3 via Vietcombank account number 0011001932418 has attracted the attention and approval of public opinion.

Transparency and honor

Not only to create transparency in calling for support and honoring the golden hearts of benefactors, the announcement of the statement by the Central Committee of the Vietnam Fatherland Front also demonstrates the serious implementation of Decree 93/2021/ND-CP of the Government on mobilizing, receiving, distributing and using voluntary contributions to support overcoming difficulties caused by natural disasters, epidemics, incidents; supporting patients with serious illnesses.

Accordingly, individuals and organizations mobilizing voluntary contributions are responsible for fully, promptly and accurately disclosing activities related to mobilizing, receiving, distributing and using voluntary contributions.

The time to declare the amount of donations is no later than 15 days after the end of the receiving period. Individuals and organizations mobilizing voluntary contributions are also responsible for publicly announcing the total amount of money distributed and used no later than 30 days after the end of the distribution and use period.

Violation of ethics and law

Then, after the ethical and legal announcement of the statement by the Central Committee of the Vietnam Fatherland Front, the online community discovered many cases of people taking advantage of the situation of calling for support for their compatriots to edit images in an insensitive way, "inflating" the amount of money donated to create a virtual reputation on social networks.

The concept of "check VAR" statement was born to refer to the work of verifying information about the amount of contributions announced by an individual or organization.

The list of people who "pretend to be charitable" and "pretend to be" in a ridiculous way is getting longer and longer, even including people who were somewhat famous before.

The act of taking advantage of charity activities and intentionally creating "misunderstandings" about the amount of donations not only shows the deceitfulness of individuals who are greedy for fame, damaging the trust of the community, but also shows signs of violating the law.

Perhaps, when committing the above illegal and immoral acts of profiting from reputation, the individuals who were "named and shamed" by the online community were not aware of the possibility that they might be violating the law.

Accordingly, in cases of amending charity transfer statements, according to the provisions of Article 101 of Decree 15/2020/ND-CP of the Government, providing false, distorted or slanderous information may be subject to an administrative fine of 5 - 10 million VND.

Notably, the act of falsifying statements and calling for charity but not transferring the exact amount of money committed can be strictly handled according to Article 175 of the 2015 Penal Code. Article 175 stipulates the crime of abuse of trust to appropriate property with a prison sentence of up to 12 years.

Send love to the right address

With recent developments, it is clear that the authorities need to implement strict sanctions to deter fraudulent acts of "charity banners".

Dealing with violations will help maintain fairness in fundraising activities and strengthen the trust of donors in particular and the people in general.

Individuals and organizations carrying out charitable activities need to further enhance transparency in collecting, managing and allocating donated resources.

Not only reporting the amount of money sent, providing settlement documents and disbursing relief funds for the right purpose and to the right recipients is also an activity that charitable organizations need to carry out, in order to build trust in the community.

Finally, people in general and philanthropists in particular need to be alert, put their love in the right place; always fully understand and carefully verify information related to charitable organizations before participating in donations. Having a heart to share is good, but the good heart needs to go to the right place, avoiding falling into the trap of fraudulent addresses.
