The Ho Chi Minh City People's Committee directed districts to "strengthen management, inspection, and supervision of after-hours childcare facilities, especially conditions to ensure absolute safety for children, and strictly prohibit extra teaching activities in after-hours childcare facilities."

In addition, the Ho Chi Minh City People's Committee directed: "Absolutely do not allow unlicensed establishments to operate (publicly list at http://dichvugiaoduc.hcm.edu.vn/) .

In early 2024, the Department of Education and Training of Ho Chi Minh City issued Official Dispatch No. 100/SGDĐT-GDNCL on rectifying the operational situation of units participating in organizing life skills education activities and extracurricular educational activities; including the request: "Units must organize educational activities according to current regulations after being licensed to operate by the Department of Education and Training; ensuring safety and separation from other educational activities according to regulations".

In March 2024, the Ho Chi Minh City People's Committee also issued a Coordination Regulation between the Department of Education and Training and departments, branches, Ho Chi Minh City Tax Department, Ho Chi Minh City Social Insurance, Thu Duc City People's Committee and districts in state management of education for non-public educational institutions in Ho Chi Minh City.

There is no separate license for "SUMMER BOARDING" activities.

The owner of a non-public educational institution in Tan Phu District (HCMC) said that in reality, in her area, the management of non-public educational institutions is very strict. The interdisciplinary inspection unit of the ward and district regularly comes down to check food hygiene and safety, fire prevention, and child safety.

An official from the Department of Education and Training in a district said that the Ho Chi Minh City People's Committee has issued documents on strengthening the management of non-public educational establishments in the city; the Department of Education and Training has also been directed by the district to coordinate with relevant departments and offices to establish an interdisciplinary inspection team to regularly inspect, review, and ensure that children in establishments and centers are cared for and protected safely. However, these are only official documents guiding the implementation of out-of-school childcare activities. Currently, there are still no specific, clear regulations on facilities that want to provide after-school/out-of-school childcare services; such as the minimum room area/child, the minimum equipment at the facility, and penalties for violations... Currently, there are no separate licenses for out-of-school boarding activities, "satellite boarding", "summer boarding" outside of school...

Mr. Ho Tan Minh, Chief of Office of the Department of Education and Training of Ho Chi Minh City, affirmed that the Department of Education and Training has not issued any documents related to the term "satellite boarding school". If any unit or center outside the school wants to organize any activities, it must ask for permission from the locality, ward, commune, district, or county level. If any center operates improperly, the district or county must be responsible for state management of these contents.

Mr. Ho Tan Minh added: ""Summer boarding" outside of school is a service agreed upon between parents and units, there is no document stipulating which units are allowed to organize boarding outside of school. Management (of units providing boarding outside of school - PV ) is under the state management of the district level, regarding food safety, regarding all content..., the Department of Education and Training does not have any documents directing related to organizing boarding outside of school".

Mr. Ho Tan Minh emphasized that non-public educational companies, centers, and units must have documents and decisions permitting the organization of educational activities issued by the Department of Education and Training. The district where these centers are located must organize inspections. If the center or unit operates in a way that is not in accordance with the license, it will be handled; if the organization operates in a way that is contrary to the license, the unit has done wrong. The district must be responsible for state management and handle the case according to regulations. The Department of Education and Training only issues licenses for professional management; any unit that teaches incorrectly will be handled by the Department of Education and Training. "The Department does not manage boarding schools outside of schools," Mr. Minh affirmed.

CHILD CARE NOT PROPERLY PERMITTED, RESPONSIBLE BEFORE THE LAW

In the summer of 2024, kindergartens and preschools in Ho Chi Minh City are allowed to keep children. The Ho Chi Minh City Department of Education and Training has issued an official dispatch guiding the organization of summer activities in 2024. The time to organize these summer activities is from June 17 to August 16, 2024.

The Ho Chi Minh City Department of Education and Training said: "Local Departments of Education and Training guide preschools to organize summer activities based on the needs of parents and caregivers, teachers' voluntary participation, and the facilities of the facility."
