Recently, the General Secretary mentioned wasting time, and time is money, so why keep fumbling around? Decentralize strongly, and clearly stipulate in the law what can and cannot be done so that people can be creative.”
This morning, November 23, at the 8th Session, National Assembly deputies discussed in groups two drafts: Law on Management and Investment of State Capital in Enterprises; Law on Digital Technology Industry. Commenting on the draft, Prime Minister Pham Minh Chinh emphasized many important issues that need to be clearly institutionalized in regulations.

Clearly define what is right to do and what is wrong to avoid.

Before analyzing many specific issues, Prime Minister Pham Minh Chinh emphasized that these are two very important draft laws in the context of our country, so the spirit must change thinking, because thinking is a resource, a vision, a driving force. The law must clearly stipulate what is right to do, what is wrong to avoid, thereby encouraging innovation. Innovation to fly high, innovation to reach far, integration to develop

The Head of Government said that our country is a developing country, the economy is in transition, the scale of the economy is still modest, the openness of the economy is high, so it is necessary to have smart mechanisms and policies to mobilize resources from the State, people, society, foreign countries...

“This is extremely important content to promote economic development in the coming period. The new era, as General Secretary To Lam said, is to build a rich, powerful and prosperous country, with happy and prosperous people. That requires innovation in operational thinking and management based on practical summaries. What is good must be promoted, what is not good must be fixed immediately, what is still stuck must be resolved, and challenges must be overcome in order to develop,” said the Prime Minister.

The Prime Minister also noted that innovation in thinking or innovation and integration must also be based on the specific conditions and circumstances of the country. Mobilizing resources must originate from internal resources such as people, nature, and historical and cultural traditions. Regarding the draft Law on Management and Investment of State Capital in Enterprises recently submitted to the National Assembly, the Prime Minister said that there are many management models, each stage has historical factors and generally fulfills the requirements set out in that context and stage. Therefore, in the process of doing, research and expansion gradually with the spirit of not being perfectionist, not being hasty, keeping what is acceptable, eliminating what is not acceptable. “I think that business activities must follow the laws of the market, the laws of value, supply and demand and competition, and cannot be intervened by administrative measures. Intervention by non-administrative agencies is not in accordance with the laws, thinking and development. We should comply with the management of businesses according to the market mechanism, international integration, suitable to Vietnam's conditions,” according to the Prime Minister. He also stated his point of view that business plans should be assigned to the board of directors (BOD) to be responsible for deciding, how to preserve and develop capital, prevent corruption, waste and negativity. The government and management agencies have tools to guide, inspect and supervise, and those tools must be clear for people to be creative.

"Just keep asking here and there, not clear"

The head of the Government also suggested that the law must boldly decentralize and delegate power. Public investment must follow the law on public investment. As for where the capital of corporations and enterprises is invested, the Board of Directors will decide and take responsibility, not asking for administrative approval. “Time, intelligence, timely and correct decisions are decisive factors for success. Agreeing with the auditing agency that when evaluating enterprises, it is necessary to evaluate the overall value brought, not each task individually, the Prime Minister gave an example that out of 10 assigned tasks, they may not do well, causing losses, but "overall the positive" is preserving and developing capital. “Private enterprises work very quickly, and they handle civil relations very well. We keep bidding, but in the end, there are blue and red teams, and continuous discipline. How can we draw out rules? Business is not a one-day or two-day business, so we have to evaluate the whole picture. If the total is still positive, but we deal with them, it is not suitable for the situation and the rules,” the Prime Minister suggested reviewing the design of tools to encourage innovation, and definitely abandoning the mindset that if we cannot manage, we must ban it.

Therefore, the draft law should regulate the management of what type of enterprise and who is directly responsible, leaving the rest to them to manage at the lower levels. For example, the Central Government manages the province, while the province manages the district, and the district manages the commune. "The program where the Central Government works at the commune level is blocked, and blocking is wasteful, so it should be given to the province in one piece, and the province decides where to allocate and who does it. The Central Government does not do it for the province, the province does not do it for the district, the district does not do it for the commune. The spirit of locality decides, locality does it, locality takes responsibility. Enterprise management also needs to follow that, not deeply intervening in F3, F4". Leading the program to eliminate temporary and dilapidated houses, the Prime Minister stated the reason for being determined to complete it in 2025 because they are doing it together. The above only supports, such as the amount of 60 million VND, the rest everyone contributes whatever they have. There are localities where he launched the program in April and when he came back in September and October to check, he found the results to be very good. “In addition to the support, they also call on their friends and relatives to help build houses worth up to 200 million VND. It proves that decentralization is very important, it is thinking, and thinking is a resource.”
