Deputy Prime Minister Tran Hong Ha has just signed Decision No. 6/2023 regulating the pilot process and procedures for approving the conversion of rice-growing land use purposes with a scale of less than 500 hectares under the authority of the Prime Minister authorized to the People's Council (PC) of Khanh Hoa province.

Accordingly, a pilot program will be conducted on procedures for approving the conversion of rice-growing land use purposes with a scale of less than 500 hectares under the authority of the Prime Minister authorized to the People's Council of Khanh Hoa province.
This Decision regulates the pilot procedures for approving the conversion of rice-growing land use purposes with a scale of less than 500 hectares in Khanh Hoa province under the authority of the Prime Minister authorized to the People's Council of Khanh Hoa province as prescribed in Clause 1, Article 5 of Resolution No. 55/2022/QH15 dated June 16, 2022 of the National Assembly.
The decision stipulates the conditions for approval of land use purpose conversion for investment project implementation, including: Investment projects that need to convert land use purpose in the cases specified above; Investment projects that need to convert land use purpose must comply with the planning and land use plan decided and approved by competent authorities and other relevant plans according to the provisions of law; Investment has been approved according to the provisions of law and the approval document is still valid at the time of proposal; For projects that must recover land according to the provisions of Clause 3, Article 62 of the Land Law, it must be approved by the Provincial People's Council; There must be a plan for using the topsoil layer according to the provisions of the law on cultivation.
The People's Committee (PC) at the district level is responsible for synthesizing the needs for land use purpose conversion of organizations, households and individuals and sending them to the Department of Natural Resources and Environment to prepare a dossier to report to the Provincial People's Committee for consideration and submission to the Provincial People's Council for decision on converting the purpose of rice-growing land to other purposes to implement the project.
In case the project is implemented in 2 or more districts, the investor must register directly with the Department of Natural Resources and Environment.
Within no more than 10 working days from the date of receipt of valid documents, the Provincial People's Committee is responsible for organizing the appraisal of the change of land use purpose. In case the documents are invalid, within no more than 2 working days from the date of receipt of the documents, the Provincial People's Committee is responsible for notifying the Department of Natural Resources and Environment.
The Provincial People's Committee submits to the Provincial People's Council for approval of the change of land use purpose. The People's Council considers and decides to approve the change of land use purpose according to the Working Regulations of the People's Council.
After receiving the approval document from the Provincial People's Council, the Provincial People's Committee shall consider and decide on land recovery, land allocation, land lease, and permission to change land use purposes in accordance with the provisions of the law on land and other relevant laws.
