Amending regulations on types of aircraft imported into Vietnam.
The Government has just issued Decree No. 89/2025/ND-CP dated April 13, 2025 amending and supplementing Clause 2, Article 12d of Decree No. 92/2016/ND-CP dated July 1, 2016 of the Government regulating conditional business lines and occupations in the field of civil aviation, which has been amended and supplemented by Clause 13, Article 1 of Decree No. 89/2019/ND-CP dated November 15, 2019 of the Government amending and supplementing a number of articles of Decree No. 92/2016/ND-CP dated July 1, 2016 of the Government regulating conditional business lines and occupations in the field of civil aviation and Decree No. 30/2013/ND-CP dated April 8, 2013 of the Government on air transport business and general aviation activities.
Decree No. 89/2025/ND-CP stipulates that aircraft types imported into Vietnam must be issued by one of the following organizations: the Federal Aviation Administration of the United States (FAA), the European Aviation Safety Agency (EASA), the Brazilian Aviation Authority, the Canadian Aviation Authority, the Russian Federation Aviation Authority, the United Kingdom Aviation Authority, the Civil Aviation Authority of China (CAAC) or the Ministry of Construction must issue or recognize the Type Certificate.
Previously, Decree No. 92/2016/ND-CP was amended and supplemented by Decree No. 89/2019/ND-CP stipulating: Types of aircraft imported into Vietnam must be granted an Aircraft Type Certificate by the US Federal Aviation Administration (FAA) or the European Aviation Safety Agency (EASA) or the Vietnamese Aviation Authority.
* The Ministry of Construction believes that limiting aircraft operating in Vietnam to only having Type Certificates issued by the Civil Aviation Authority of Vietnam, or FAA or EASA (without allowing aircraft to be issued Type Certificates issued by other countries) will limit airlines' opportunities to access aircraft designed and manufactured by other countries with global capacity in science and technology.
Based on the practical needs of aviation activities and aviation safety assurance, the Ministry of Construction believes that amending the above regulations will create conditions for Vietnamese aviation enterprises to proactively supply aircraft and proactively operate aircraft. Thereby, enhancing international cooperation and friendship with traditional partners.
