On December 18, the Ministry of Finance issued Official Dispatch 02/CD-BTC to Ministers, Heads of central agencies; Chairmen of People's Committees of provinces and centrally run cities on strengthening the handling of assets and working headquarters of agencies and organizations in administrative units that have been arranged for the period 2029-2021 and the direction 2023-2030.

Strengthening the handling of assets and offices of agencies and organizations in administrative units that have been arranged in the period 2029-2021 and the direction 2023-2030. Accordingly, after the Prime Minister's dispatch, although the ministries and local branches have been more active and proactive in formulating, approving and organizing the implementation of plans to rearrange and handle houses and land when arranging administrative units at the district and commune levels; however, the progress of handling houses and land when implementing the arrangement of administrative units at the district and commune levels is still slow, not meeting the requirements, including the situation of many headquarters being left empty. In order to continue to speed up the progress of handling headquarters and public assets when implementing the arrangement of district and commune-level administrative units, the Minister of Finance requested that Ministers, Heads of central agencies, Chairmen of People's Committees of provinces and centrally run cities pay attention to directing the implementation of contents such as resolutely directing, urging, and organizing the rearrangement and handling of headquarters (houses, land), public assets at agencies, organizations, and units under district and commune-level administrative units arranged according to the provisions of the Law on Management and Use of Public Assets, Decree No. 151/2017/ND-CP dated December 26, 2017 detailing a number of articles of the Law on Management and Use of Public Assets, Decree No. 167/2017/ND-CP dated December 31, 2017 regulating the rearrangement and handling of public assets, Decree No. 67/2021/ND-CP dated July 15, 2021 amending and supplementing a number of articles of Decree No. 67/2017/ND-CP, Circular No. 37/2018/TT-BTC dated April 16, 2018, Circular No. 125/2021/TT-BTC dated December 30, 2021 of the Ministry of Finance and guiding documents of the Ministry of Finance for agencies, organizations and units in the area of ​​restructuring administrative units at district and commune levels in the period 2019-2021: <a title=" width="1000" height="663">

Review the approval of the plan for rearranging and handling houses and land and the implementation of the plan for rearranging and handling houses and land of agencies, organizations and units subject to rearrangement; on that basis, develop a plan to complete the approval of the rearrangement plan and complete the implementation of the plan for rearranging and handling houses and land in 2024. Regarding the handling plan: Based on the form of handling public assets prescribed in Article 40 of the Law on Management and Use of Public Assets, Decree No. 151/2017/ND-CP, Article 7 of Decree No. 167/2017/ND-CP (amended and supplemented in Clause 7, Article 1 of Decree No. 67/2021/ND-CP), the People's Committees of provinces, ministries and central agencies shall develop appropriate handling plans. Ministries and central agencies with headquarters and vertical units located in district- and commune-level administrative units that have been reorganized in the 2019-2021 period and are no longer in need of use, shall base on the forms of handling houses and land in Decree No. 167/2017/ND-CP and Decree No. 67/2021/ND-CP of the Government to reorganize and handle houses and land; in which, note the direction of the Prime Minister: "Urgently transfer headquarters, houses and land to the People's Committees at the provincial level for effective management and use, avoiding waste, negativity and corruption" in Section 2 of Official Dispatch No. 771/CD-TTg dated August 29, 2023. Speed ​​up the progress of adjusting and updating land use planning and plans and related plans; carry out administrative procedures on land, determine starting prices for auctions in the sale and transfer of public assets. The sale and transfer (including liquidation) of assets must be public, transparent and in accordance with the law. In cases where houses and land are transferred to local management and handling, the handover and acceptance must be carried out immediately for use or handling according to regulations; the leaving of unused, damaged or degraded assets must be minimized. Organizing delegations and working groups to directly urge, guide, direct and inspect the implementation of rearrangement and handling of houses, land and public assets at agencies, organizations, units and localities where implementation is slow, many houses, land and public assets have not been rearranged, handled or have encountered problems.
