How did the Government Inspector expose Xuyen Viet Oil's violations?

The Government Inspectorate will begin its inspection of compliance with policies and laws in state management of petroleum in October 2022. This is an inspection under the direction of the Prime Minister on ensuring the supply of petroleum to the domestic market.

In the recently announced conclusion, the Government Inspectorate affirmed that Xuyen Viet Oil Trading, Transport and Tourism Company Limited had negative equity of over VND462 billion; owed the State over VND1,246 billion in environmental protection tax; and owed the Petroleum Price Stabilization Fund over VND212 billion.

According to the inspector's calculation, although the company owes (preliminary calculation) over 1,920 billion VND, it is currently owing Ms. Mai Thi Hong Hanh, Chairwoman of the company's Board of Directors, 2,978 billion VND.

The Government Inspectorate also discovered that Xuyen Viet Oil Trading, Transport and Tourism Company Limited issued value-added invoices to the Military Petroleum Corporation for gasoline output that did not match the actual gasoline output.

In the first 7 months of 2022, Xuyen Viet Oil Company issued value-added invoices with the gasoline output on the invoice being higher than the actual output delivered by 2,580m3 of gasoline and 7,433m3 of DO oil, affecting the business results of the enterprise; the declaration and payment of environmental protection tax and the allocation and use of the Gasoline Price Stabilization Fund.

The Government Inspectorate has transferred the case file of violations of the law in declaring and paying environmental protection tax on gasoline at Xuyen Viet Oil Trading, Transport and Tourism Company Limited to the Investigation Agency - Ministry of Public Security for consideration and handling.

For many years, Xuyen Viet Oil Company has been one of the largest petroleum trading enterprises in the country.

In early September 2023, the Ministry of Public Security announced its decision to prosecute Ms. Mai Thi Hong Hanh, Director of Xuyen Viet Oil Company and Deputy Director Nguyen Thi Nhu Phuong for violating regulations on management and use of State assets, causing loss and waste.

At the press conference in late December 2023 in Hanoi, the Ministry of Public Security informed about the process of expanding the investigation into the case of Violations of regulations on management and use of State assets causing loss and waste; Lack of responsibility causing serious consequences; Giving bribes; Receiving bribes; Taking advantage of positions and powers to influence others for personal gain occurring at Xuyen Viet Oil Company and a number of related agencies and organizations.

Up to now, the Ministry of Public Security has determined that from the end of 2021 to April 2022, Mr. Le Duc Tho (former Secretary of Ben Tre Provincial Party Committee) took advantage of his position, authority and prestige to receive material benefits from Mai Thi Hong Hanh to influence credit institutions to facilitate Xuyen Viet Oil Company to be granted credit limits, loans and disbursements with preferential conditions.

Mr. Le Duc Tho was prosecuted and temporarily detained for the crime of "Abusing position and power to influence others for personal gain."

In addition, Mr. Hoang Anh Tuan, Deputy Director of the Market Department (Ministry of Industry and Trade) and Dang Cong Khoi, Deputy Director of the Price Management Department (Ministry of Finance) were prosecuted for the crime of Lack of responsibility, causing serious consequences.

Mr. Le Duy Minh, former Director of the Ho Chi Minh City Tax Department and Director of the Ho Chi Minh City Department of Finance, was prosecuted for accepting bribes.

Also in this case, Deputy Minister of Industry and Trade Do Thang Hai was prosecuted for accepting bribes.
