Quang Nam determined to remove difficulties for real estate businesses

Many difficulties

Mr. Tran Quoc Bao - Chairman of the Provincial Business Association said that the real estate business community is facing many difficulties in implementing projects; in which the most prominent is the problem of compensation and site clearance, stemming from the capacity of the agency in charge of compensation, current status management and the lack of determination of the locality.

Mr. Bao said that in many cases, compensation and resettlement support plans were approved more than 4 years ago, but households still did not receive money and hand over the land, even though the local government organized many dialogues and mass organizations participated in the campaign.

"Some problems have been resolved many times by local authorities and compensation units. There have even been more than 5 notices of conclusions and instructions from local leaders but they have not been resolved, causing the project to be prolonged," said Mr. Bao.

Ms. Nguyen Thi Minh Chau - Vice Chairman of Dien Ban Town People's Committee said that the site clearance work in the locality encountered many difficulties, the cause was related to old projects in the past, a part of the people requested compensation for agricultural land with residential land and resettlement arrangements. The locality also encountered difficulties in examining the origin of land in Dien Ngoc ward.

“Land repossession is also very difficult to implement because the old project files are full of holes; if enforcement is carried out, it is necessary to have the opinions of the provincial police, the Department of Natural Resources and Environment and related sectors, and at the same time ensure the rights of the people,” said Ms. Nguyen Thi Minh Chau.

In addition, in Dien Ban town, there are 20 real estate projects that overlap the boundary with the Co Co River Dredging Project invested by the Provincial Traffic Construction Investment Management Board. Currently, the parties are actively working to clearly define the overlapping boundary, thereby thoroughly resolving it.

Regarding the issue of land allocation, Mr. Tran Quoc Bao said that if a part of the project area is not allocated land, the investor cannot implement the project on schedule, nor can it be handed over for use, which can easily lead to re-encroachment.

According to Mr. Bao, the allocation of "leopard skin" land without being granted a land use right certificate and not being allowed to separate and transfer plots does not bring meaningful relief to investors.

Mr. Tran Quoc Bao proposed that relevant departments, agencies and sectors issue regulations on land division, transfer, registration of changes, and issuance of sub-books from block books for qualified enterprises. “We are facing many difficulties, many banks see Quang Nam real estate enterprises as “ignoring” because they do not dare to hold the books of these enterprises” - Mr. Bao shared.

The Chairman of the Provincial Business Association also raised difficulties in the timing of the obligation to deposit to ensure project implementation. The Association recommended that for projects with compensation advances larger than the deposit but the project is behind schedule due to the locality's fault in delaying the handover of the site and not the investor's fault, the deposit will continue to be temporarily suspended and the progress will be extended according to regulations.

Quang Nam currently has 177 residential and urban area projects under implementation; of which 17 projects have been completed and finalized; 18 projects including completed, handed over for use but not yet finalized and projects that have been basically completed but not yet accepted or finalized; 120 projects under implementation (25 projects have had decisions on selecting investors and 95 projects have been handed over to investors).

Determined to remove

The representative of the Department of Planning and Investment said that out of 120 ongoing projects, 57 projects are still on schedule; 21 projects are still on schedule according to the original policy document; 36 projects have had their progress adjusted; 7 projects are out of schedule and the department has compiled them; 10 projects are out of schedule and have reported difficulties; 5 projects are out of schedule but are being inspected by relevant agencies; 6 projects are out of schedule and the department has compiled and reviewed them according to regulations.

The Department of Planning and Investment is submitting an extension of the progress of 18 projects, and the Department has requested deposits for 13 other projects that are out of progress to consider extending the extension. There are also 4 projects that have been requested to submit documents. The biggest difficulty in extending the progress is the impact of new legal regulations such as the 2024 Land Law and these projects have been determined by the Central Inspection Committee to have allocated land without bidding. And in extending the progress, there are also difficulties with deposits because investors refuse to deposit.

According to Vice Chairman of the Provincial People's Committee Tran Nam Hung, Quang Nam always creates the best conditions for businesses to operate and develop, but must comply with the provisions of the law and fulfill financial obligations and the state budget.

Emphasizing that compensation and site clearance are decisive factors in removing difficulties for real estate projects, Vice Chairman of the Provincial People's Committee Tran Nam Hung suggested that localities consider this an important and regular political task.

“Localities need to develop specific, detailed plans for each project to implement; coordinate with businesses in propaganda and mobilization of people. On that basis, there must be minutes of work with investors to announce tasks and clarify responsibilities between parties,” Mr. Hung noted.

Regarding the extension of the investment progress, Mr. Hung said that the province only agrees to extend the progress when the investor makes a deposit according to the provisions of current law. Vice Chairman of the Provincial People's Committee Tran Nam Hung assigned the Department of Planning and Investment to work with the enterprise, advise the Provincial People's Committee to consider the extension with the condition that there is confirmation from the locality about the amount of money the investor has advanced to carry out site clearance.

Vice Chairman of the Provincial People's Committee Tran Nam Hung also approved the policy of dividing the project implementation progress into phases. Phase 1 will hand over land first for resettlement for on-site resettlement projects in accordance with approved detailed planning and complete the framework infrastructure.

“After allocating resettlement land, it is agreed that the remaining land area will be divided into a maximum of 2 phases. The plots must be adjacent to each other according to the approved 1/500 detailed plan. The province will also study the maximum issuance of certificates for each phase that has been divided into phases,” said Vice Chairman of the Provincial People’s Committee Tran Nam Hung.
