According to Article 53 of the Road Traffic Law, vehicles wishing to participate in traffic on the road must be registered and have a license plate issued by a competent State agency. Therefore, during the time without a license plate, vehicles are not allowed to circulate on the road, except for temporarily registered vehicles.
Article 12 of Circular 58/2020/TT-BCA specifically lists 04 cases of temporarily registered vehicles as follows:
- Vehicles that have not been registered or officially issued license plates and need to participate in traffic;
- Vehicles registered abroad are permitted by competent authorities to enter Vietnam for tourism, conferences, fairs, exhibitions, physical education and sports;
- Vehicles serving conferences organized by the Party, State and Government;
- Cars that have undergone procedures to revoke their registration certificates and license plates for re-export to the country or transfer in Vietnam and cars that have a decision to transfer, sell, give or donate.
According to this regulation, people who have just bought a car and are waiting for the vehicle registration and official license plate must apply for a temporary registration to be allowed to participate in traffic.
However, the temporary vehicle registration certificate is valid for a maximum of 30 days and the temporarily registered vehicle may only participate in traffic according to the period, route and scope of operation stated in the temporary vehicle registration certificate.
In case of participating in traffic on the road without temporary registration, the driver will be punished according to the provisions of Decree 100/2019/ND-CP, amended by Decree 123/2021/ND-CP.
Accordingly, the act of driving a car without a license plate on the road in violation of regulations will be fined from 2-3 million VND, and the driver's license will be revoked for 1-3 months. In the case of a car with a license plate but no registration, the driver will also be fined the same amount, but the vehicle may be confiscated.
Similarly, for motorbikes, drivers can be fined from 800,000 to 1 million VND for driving without a license plate. For vehicles without registration papers, drivers will also be fined the same amount, but may have their vehicle confiscated.
Procedures for temporary vehicle registration
Depending on the type of vehicle and the purpose of temporary registration, different dossier components are specified in Article 13 of Circular 58/2020/TT-BCA as follows:
- Vehicles manufactured and assembled in Vietnam: Vehicle registration declaration (form No. 01); Copy of sales invoice as prescribed or warehouse delivery note.
- Imported vehicles; temporary import for re-export with a limited time limit, transit: Vehicle registration declaration (according to form No. 01); Copy of Export and Import Goods Declaration or detailed vehicle import declaration.
For vehicles that have completed import procedures, registration procedures, and temporary license plates and documents. According to regulations in Clause 1, Article 8, Circular 58/2020/TT-BCA.
- Vehicles permitted by competent authorities to enter Vietnam (To serve conferences, fairs, exhibitions, physical education and sports; foreign vehicles entering Vietnam for tourism and vehicles serving conferences organized by the Party, State and Government): Copy of vehicle registration certificate or list of vehicles approved by competent authorities for registration request.
- Foreign cars, registered abroad (right-hand drive (reverse steering wheel), left-hand drive participating in traffic in the form of Canavan) are allowed to participate in traffic according to the provisions of law: Vehicle registration declaration (according to form No. 01); Document allowing participation in traffic in Vietnam from the competent authority.
