1. What is a movie?

According to Clause 2, Article 3 of the 2022 Law on Cinema, a film is a cinematographic work with content expressed in continuous moving images or images created by technical and technological devices; with or without sound and other effects according to the principles of cinematographic language; recorded on materials, by digital or other technical means and disseminated to viewers, including feature films, documentaries, scientific films, animated films and films combining many types.

Films do not include recorded products for the purpose of disseminating news on radio, television, cyberspace; art performances, electronic games; recorded products about the activities of one or more people, describing events, situations or reality shows.

2. Cases where film distribution will be stopped according to the 2022 Cinema Law

According to Clause 2, Article 30 of the 2022 Cinema Law, the competent state agency shall decide to stop the dissemination of films in writing, clearly stating the reason, time, and duration of stopping the dissemination of films in one of the following cases:

(1) Violating the provisions of Article 9 of the 2022 Cinema Law on prohibited content and acts in cinematographic activities as follows:

- Cinematographic activities with the following content are strictly prohibited:

+ Violating the Constitution and laws; inciting opposition or sabotaging the implementation of the Constitution and laws;

+ Propaganda against the Socialist Republic of Vietnam; sabotage of the great national unity bloc; harm to the national interests, ethnic groups, and cultural values ​​of Vietnam; insult the National Flag, Party Flag, National Emblem, and National Anthem;

+ Propaganda inciting wars of aggression, causing hatred and discrimination between ethnic groups and peoples of different countries; spreading reactionary ideologies and social evils; destroying culture and social ethics;

+ Distorting national history, denying revolutionary achievements; insulting the nation, celebrities, and national heroes; incorrectly representing or violating national sovereignty; slandering or insulting the reputation of agencies, organizations, and the honor and dignity of individuals;

+ Propagating and supporting terrorism and extremism;

+ Inciting and insulting beliefs and religions; propagating and promoting illegal religious activities;

+ Disclosing state secrets, personal privacy secrets and other secrets as prescribed by law;

+ Inciting violence and criminal acts by showing in detail the methods of execution, images, sounds, dialogues, scenes of brutal and savage beatings, torture, murders and other acts that offend human dignity, except in cases where such content is shown to criticize, denounce, condemn crimes, promote justice, and honor traditional and cultural values;

+ Showing detailed images, sounds, and dialogues that are obscene, depraved, and incestuous;

+ Violating the rights and legitimate interests of children and minors;

+ Violating the principles of gender equality, gender stereotypes, and gender discrimination.

- The following acts are strictly prohibited:

+ Distributing and distributing films in cinemas, on television systems and public film screening locations without a Film Classification License from a competent state agency on cinema (hereinafter referred to as a Film Classification License) or a Broadcasting Decision from a press agency with a television operating license (hereinafter referred to as a Broadcasting Decision);

+ Disseminate films on cyberspace without classifying or displaying film classification results according to the provisions of the 2022 Cinema Law;

+ Changing or distorting the content and classification results of films that have been granted a Film Classification License or Broadcasting Decision;

+ Producing, distributing, disseminating, screening, and archiving films that do not comply with the provisions of the 2022 Cinema Law, the Intellectual Property Law, and other relevant legal provisions;

+ Release and distribute films that have had their Film Classification License or Broadcasting Decision revoked;

+ Copying films without the consent of the film owner, except in cases where the Law on Intellectual Property provides otherwise;

+ Failure to notify the competent state agency when disseminating films at public screening locations;

+ Appraising and granting film classification licenses in violation of the law.
