The lawsuit, filed in federal court in Florida on April 3, alleges that President Donald Trump lacks the legal authority to impose the comprehensive tariffs he announced on April 2 as well as the duties authorized on February 1 under the International Emergency Economic Powers Act (IEEPA).

NCLA filed the lawsuit on behalf of Simplified, a Florida-based home management products retailer, Reuters reported, marking the first lawsuit against the Trump administration over the tariffs announced by the White House.
The plaintiffs are asking the judge to block the implementation and enforcement of the tariffs and to overturn Mr. Trump’s changes to the U.S. tariff schedule. They argue that the U.S. president can only impose tariffs with the authorization of Congress and according to complex trade laws that dictate how and when they apply.
“Such rules require prior investigations, detailed factual findings, and a close match between statutory authority and the scope of the tariff,” NCLA’s lawsuit states.
The case was assigned to U.S. District Judge Kent Wetherell, a Trump appointee who blocked a key part of former President Joe Biden's immigration policy in 2023.
It is not yet clear what the Court's ruling will be, but according to the New York Times, the case is setting the stage for what could become a legal battle that will be closely watched around the world.
