The Standing Committee of the National Assembly agreed to submit to the National Assembly for consideration and decision on the pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights at the 8th Session.

On behalf of the National Assembly Standing Committee, Chairman of the Economic Committee Vu Hong Thanh has just signed and issued the Conclusion of the National Assembly Standing Committee on the Draft Resolution of the National Assembly on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights, according to the National Assembly Electronic Information Portal.

Accordingly, on the morning of November 3, the National Assembly Standing Committee gave its opinion on the above draft Resolution according to Submission No. 735/TTr-CP dated October 29, 2024 of the Government.

The Standing Committee of the National Assembly agreed to submit to the National Assembly for consideration and decision on the pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights at the 8th Session of the 15th National Assembly (according to the procedure at a session).

The Government is requested to study and absorb the opinions of the National Assembly Standing Committee at the meeting on November 3, 2024 and Conclusion No. 1032/KL-UBTVQH15 dated October 28, 2024 of the National Assembly Standing Committee, the review opinions of the Standing Committee of the Economic Committee, the Standing Committee of the Ethnic Council and the Standing Committees of other Committees; urgently complete the draft Resolution dossier and send it to the National Assembly no later than November 7, 2024 to supplement the Program of the 8th Session of the 15th National Assembly, the conclusion stated.

The conclusion also stated a number of contents noted by the National Assembly Standing Committee.

Specifically, research the name of the Resolution, ensure compliance with the provisions of the Law on Promulgation of Legal Documents, only stipulate the pilot implementation of a number of new policies under the decision-making authority of the National Assembly but which do not have any governing laws or are different from the provisions of current laws.

Regarding the scope of regulation, the National Assembly Standing Committee requested clarification of the basis, grounds, urgency, effectiveness, feasibility and consistency with the conclusion of competent authorities on the nationwide pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights for the scope of regulation of the Resolution.

The National Assembly Standing Committee also noted to review, research, and prescribe appropriately, avoiding overlap between applicable subjects and creating consistency in the Resolution.

Regarding the conditions for project implementation, the conclusion clearly states the requirement to clarify the basis and grounds for the pilot for all types of land specified in Article 9 of the 2024 Land Law; the application of the pilot mechanism to the conditions for receiving the transfer of land types specified in the Land Law, the pilot conditions are based on the time of receiving land use rights (or having land use rights).

Strict regulations on adjusting district-level land use planning, construction planning, and urban planning related to the scope of the pilot land. The pilot implementation must ensure compliance with the rice-growing land area, forest coverage ratio, and land indicators decided by competent authorities, according to the conclusion.

Regarding the criteria for selecting pilot projects, the National Assembly Standing Committee noted that it is necessary to clarify the basis and grounds and review them to ensure their strictness, effectiveness, feasibility and not contrary to the conclusions of competent authorities regarding the criteria for selecting pilot projects. The criteria need to be specific, clear, transparent and have an order of priority to select investors with the capacity to implement the pilot project. Study the opinions of the appraisal agency on the proposal not to stipulate for defense land and security land that have been removed from the planning.

The National Assembly Standing Committee also agreed to assign the Government to specify in detail the procedures for implementing commercial housing projects through agreements on receiving land use rights or having land use rights.

With the pilot mechanism, the conclusion stated, research regulations on time to implement agreements on receiving land use rights; handling legal consequences in case the agreement is prolonged, the investor cannot complete the project or implement the project not on schedule, not completing the project according to the schedule reviewed and approved by the competent authority.

The National Assembly Standing Committee approved the pilot regulation to be implemented for a period of 5 years.

The Government fully forecasts risks to propose appropriate regulations to be included in the Draft Resolution of the National Assembly or implement solutions within its authority to prevent negativity, speculation, policy profiteering or leaving land fallow or widespread commercial housing investment exceeding demand, leading to vacancy, waste or causing other consequences for the economy, affecting macroeconomic stability. At the same time, it is responsible for the conformity of the proposed contents in the Submission and the Draft Resolution with the conclusions of competent authorities, according to the conclusions of the National Assembly Standing Committee.
