Accordingly, implementing the Law on Military Service dated June 19, 2015, Decision No. 102/QD-TTg dated September 20, 2024 of the Prime Minister on calling citizens to join the army in 2025, Instruction No. 4705/HD-BQP dated October 31, 2024 of the Ministry of National Defense on selecting and calling citizens to join the army in 2025, from February 13 to 15, young people nationwide will leave to perform military service in 2025.
According to the plan, the 2025 military enlistment ceremony in localities will take place over 3 days. Specifically, on February 13, 52 provinces and cities will hold military enlistment ceremonies, including: Hanoi Capital Command; 6 provinces of Military Region 1; 4 provinces of Military Region 2; 9 provinces and cities of Military Region 3; 11 provinces and cities of Military Region 5; 9 provinces and cities of Military Region 7; 12 provinces and cities of Military Region 9.
On February 14, 6 provinces and cities held military handover ceremonies under Military Region 4. On February 15, 5 provinces under Military Region 2 held military handover ceremonies.
From February 13 to 15, young people across the country will leave for military service in 2025.
Citizens who are going to do military service in 2025 need to pay attention to some regulations on administrative sanctions in the field of national defense and key issues regarding how non-compliance with mobilization orders will be handled according to the law to ensure their rights.
Specifically, according to Decree 37/2022/ND-CP dated June 6, 2022 of the Government stipulating amendments and supplements to a number of articles of Decree No. 120/2013/ND-CP dated October 9, 2013 of the Government stipulating sanctions for administrative violations in the fields of national defense and cryptography.
Article 6 of Decree 37/2022/ND-CP clearly states that if one violates regulations on medical examination and check-ups for military service, one will be fined from 10 million VND to 12 million VND for not being present at the correct time or place for medical examination and check-up.
A fine of 12 to 15 million VND will be imposed for intentionally not accepting the call for military service medical examination.
Military service 2025: What will happen if you do not comply with the mobilization order?
Any person who undergoes a medical examination and commits fraudulent acts to falsify the results of his/her health classification in order to evade military service; gives money, property, or other material benefits worth less than 2 million VND to medical officers, employees, or other persons to falsify the results of the health classification of the person being examined or the person undergoing a medical examination for military service in order to evade military service shall be fined from 15 million VND to 20 million VND.
Anyone who fails to comply with the call for military service medical examination will be fined from 25 million to 35 million VND.
According to Article 7 of Decree 37/2022/ND-CP, if violating regulations on military service, a fine of 30 million to 40 million VND will be imposed for not being present at the correct time or place of gathering.
Anyone who commits fraudulent acts to avoid carrying out the military service call after having obtained the results of the military service health examination and meeting the requirements for military service according to regulations will be fined from 40 million to 50 million VND. A fine of 50 million to 75 million VND will be imposed if the military service call is not followed.
Evading military service can result in imprisonment.
People who evade military service, in addition to being administratively fined, may also be held criminally responsible for evading military service under Article 332 of the 2015 Penal Code.
Accordingly, anyone who fails to register for military service, has been called up for military service, has been punished for violating this act, or has been convicted of evading military service, has not had his/her criminal record cleared, and still violates, shall be subject to non-custodial reform for up to 2 years; or imprisonment from 3 months to 2 years.
If the crime is committed in cases of self-inflicted injury or damage to one's health; committed during wartime, or enticed others to commit crimes, the penalty is imprisonment from 1 to 5 years.
