In her opening speech, Chairwoman of the City People's Council Nguyen Thi Le said that in recent times, the strong development of commercial housing projects has contributed to changing the face of the city, meeting housing needs, improving and raising people's living standards.
The 2013 Land Law and the 2014 Housing Law both affirm that the State recognizes and protects the legal land use rights, house ownership rights, and assets attached to land of the owners. However, ensuring the legal rights of people owning commercial housing still has many limitations. The delay in granting certificates of land use rights, house ownership rights, and other assets attached to land has greatly affected the legitimate rights and interests of the people, causing heavy economic losses to the people, as well as budget losses to the State.
“In reality, there have been many complaints and petitions from residents regarding the delay in granting certificates at commercial housing projects, with some projects still not being granted certificates after more than 20 years. This also affects the implementation of security, order and social safety in local state management. This is also the content that many voters have reflected and recommended to the City People's Council delegates in recent times,” said the Chairman of the City People's Council.
Many apartment projects in Ho Chi Minh City are facing many difficulties in issuing pink books.
According to the Chairman of the City People's Council, this is a complicated issue that has existed for many years and has many difficulties in solving. It is necessary to go into depth, analyze and evaluate each issue carefully in order to remove difficulties and obstacles, speed up the progress of granting certificates to home buyers, and ensure the legitimate and legal requirements and rights of people and businesses. For that reason, the Standing Committee of the City People's Council has chosen this issue to organize an explanation activity at the meeting of the Standing Committee of the City People's Council with the theme "Issuance of certificates of land use rights, house ownership rights and other assets attached to land for organizations and individuals in commercial housing development projects in Ho Chi Minh City".
Reporting at the explanation session, Director of the Department of Natural Resources and Environment of Ho Chi Minh City Nguyen Toan Thang said that according to incomplete reports, before the 2013 Land Law took effect (July 1, 2014), Ho Chi Minh City had 105 commercial housing projects with 24,501 apartments that had been granted certificates of land use rights, home ownership rights and assets attached to land (pink books).
After the above phase, according to statistics, 335 projects were put into use with more than 191 thousand apartments eligible for certificates. Of which, the number of apartments that have been granted certificates is more than 110 thousand apartments, the remaining number of apartments is more than 81 thousand apartments that have not been granted certificates.
Among the apartments that have not been granted certificates, there are 8.3 thousand apartments in projects where the investor has submitted applications for certificates, issued tax notices, and is waiting for people to pay taxes. There are nearly 20 thousand apartments in projects where the procedures for granting certificates are being carried out but have been suspended due to the need to fulfill additional financial obligations.
In particular, more than 10,000 apartments in 18 projects have had their certificates temporarily suspended due to being inspected and investigated. Nearly 9,000 apartments have not been granted certificates due to being stuck with regulations on new types of real estate. The remaining apartments are for which investors and residents have not submitted their applications or have other problems.
Meanwhile, the monitoring report on granting pink books of the City People's Council stated that according to the report and classification of the Department of Construction, the statistics are different from the Department of Natural Resources and Environment. Accordingly, in Ho Chi Minh City, there are 406 apartment projects, 56 apartment buildings have completed procedures but have not been granted pink books and 136 apartment buildings have not completed procedures to grant books.
