The Ministry of Finance proposed to exempt tax on goods imported via e-commerce with a value of VND2 million or less, but limit the purchase value to no more than VND96 million/year.


Prohibition of collecting goods under license-exempt standards

The Ministry of Finance is seeking comments on a draft Decree regulating customs management of exported and imported goods traded via e-commerce. One of the notable contents in the draft is inspection, specialized management, and tax policies for exported and imported goods traded via e-commerce.

Accordingly, the Ministry of Finance proposed 2 options for exemption of licenses, conditions, and specialized inspections for goods imported and exported via e-commerce. Option 1 : Goods not on the list of goods exempted from licenses and inspections according to the decision of the management agency.

Option 2 : Goods imported via e-commerce under 2 million VND do not have to be inspected up to 4 times and the total value of exempted goods does not exceed 96 million VND/year. This is to limit buyers from taking advantage of the policy, dividing goods into smaller parts to be exempted from inspection.

The Ministry of Finance also strictly prohibits individuals and organizations from collecting goods according to the standards of exemption from licenses, conditions, and specialized inspections of organizations and individuals purchasing goods through e-commerce transactions.

The drafting of the decree aims to create a separate, complete, clear and transparent legal corridor on management policies and electronic customs procedures to facilitate organizations and individuals in exporting and importing goods via e-commerce; meeting the requirements of effective customs management.

Imported goods worth less than 1 million VND are not exempt from tax.

Also related to taxes on imported goods via e-commerce platforms, according to Decision 01/2025, from February 18, 2025, goods with a value of less than 1 million VND when sent via express delivery service will be subject to import tax and value added tax.

Mr. Hoang Ninh - Deputy Director of the Department of E-commerce and Digital Economy (Ministry of Industry and Trade), this decision has an important impact on the e-commerce retail market in Vietnam in terms of state management and the activities of businesses and consumers.

Specifically: The imposition of import tax and value-added tax on goods valued at less than VND1 million sent via express delivery service is a step forward in ensuring fairness between imported goods and domestically produced and traded goods. The new regulation will contribute to establishing a more equal playing field, supporting domestic enterprises to develop sustainably.

In addition, this regulation may make the prices of goods imported from outside Vietnam less attractive because the prices are too competitive. This will encourage consumers to consider more carefully when shopping for imported goods, thereby increasing the demand for domestic goods, especially products of equivalent quality. This is an opportunity for domestic enterprises to improve their competitiveness and enhance product quality.

From a management perspective, the new regulation will help authorities better control the flow of imported goods, especially in the context of cross-border e-commerce platforms operating strongly in Vietnam. Uniform tax collection will help increase state budget revenue, while limiting the abuse of tax exemption policies to import poor quality goods or trade fraud.

According to data from the Metric data platform, in 2024, the market witnessed a significant increase in imported goods via e-commerce channels, with more than 324 million products imported into Vietnam, with sales of VND 14,200 billion. This level increased by nearly 38% and 43% respectively compared to 2023.
