Proposal to publish list of artists violating advertising

Artists are not innocent

Regarding the current cases of artists participating in illegal advertising on social networks, Associate Professor Dr. Bui Hoai Son - Standing Member of the National Assembly's Committee on Culture and Education - said that this is a worrying situation.

"It is not just a story about the market, but a story about conscience, professional ethics and civic responsibility in the digital media era. Artists do not only work to satisfy their personal passions, but also shape consumer trends, inspire life, and directly influence social behavior, especially among young people," Associate Professor Dr. Bui Hoai Son said.

Artists cannot take lightly each introduction and each advertisement, because behind it are hundreds of thousands, even millions of fans who trust and follow. However, reality shows that many artists are willing to "sell their voice", "sell their image", "sell their reputation" in exchange for advertising contracts.

Many people don’t even know what they are advertising. They just want to know how much the brand paid, not whether the product is really good or up to standard.

"Artists must always be alert. Working in this profession requires not only the ability to perform but also knowing how to preserve honor. Each product associated with one's own image is an implicit commitment to the public. If that product is in violation, the artist cannot deny responsibility. No one can both receive advertising money and be innocent when the consequences occur," Associate Professor Dr. Bui Hoai Son emphasized.

Many artists have been called out for advertising milk with exaggerated benefits.

Announcing the list of artists violating advertising

In 2024, in the draft Law amending and supplementing a number of articles of the Advertising Law, the Ministry of Culture, Sports and Tourism (MOCST) proposed to add a provision on the activities of influential advertising product transmitters.

Accordingly, the activities of influential advertising product carriers must comply with regulations such as: having a written contract with the organization or individual whose product or service needs to be advertised; if posting opinions or feelings about the use of goods or services, there must be specific evidence of direct use of the product...



Celebrities have to be responsible when advertising products so they don't have to trade their entire careers for a few advertising contracts.

The process of amending the law requires a long time for research, appraisal, comments and promulgation, while society is still "heating up" every day with a series of cases of celebrities advertising falsely and deceiving consumers.

"In addition to the 2012 Advertising Law, the Consumer Rights Protection Law, decrees on administrative sanctions in the fields of culture, health, commerce, etc. are still in effect. We cannot let the situation where laws exist but are not used become an excuse for artists to carelessly accept false advertising," Associate Professor, Dr. Bui Hoai Son emphasized.

Until the revised Advertising Law is passed, the legal vacuum cannot become a safe zone for fraud. The regulatory agency needs to act promptly to protect not only consumers, but also the purity of the artistic environment and the honor of genuine artists.

"Artists cannot continue to have the mindset of script readers, then be innocent when the audience is deceived and consumers are hurt," Associate Professor Dr. Bui Hoai Son affirmed.

Artists cannot use the excuse of reading from the script to cover up their own wrongdoings.

In addition to administrative sanctions, it is necessary to increase the forms of warning that are deterrent and public. Mr. Son proposed to publish the list of artists who violate advertising in the mass media. For him, this is not to ridicule or degrade the image of artists, but a way to remind them that celebrities cannot stand outside of moral and legal responsibilities.

"When public trust is damaged, they have the right to know who caused it. Artists need to have basic legal knowledge about advertising. They need to clearly understand what false advertising, misleading advertising, unverified advertising are and what products need a license before being broadcast," Mr. Son suggested.

In addition, artists need support from professional teams such as lawyers, media managers, and brand consultants to evaluate advertising agreements systematically. Artists should not continue to work based on emotions, because a small mistake today can cost a lifetime career in the future.
