YouTube urged to protect rights of Wolfoo animation owners

This is the second time the Department of Radio, Television and Electronic Information has sent a dispatch to Google regarding the copyright dispute between the two animated films Wolfoo and Peppa Pig that has occurred since the beginning of 2022.

Previously, on November 25, 2022, the Department of Radio, Television and Electronic Information sent an official dispatch to Google requesting to review, verify and resolve the intellectual property rights complaint between Sconnect Vietnam Technology and Service Investment Company Limited (Sconnect) and Entertainment One UK Limited (abbreviated as EO or eOne) regarding videos about the Wolfoo cartoon character set on the YouTube platform.

Since then, the Department of Radio, Television and Electronic Information has continued to receive feedback and updates from Sconnect about the intellectual property rights of the Wolfoo cartoon character set being violated by EO on YouTube, causing a lot of damage.

According to a report by Sconnect Vietnam and public information, all trademarks and copyrights related to the Peppa Pig cartoon have been transferred from EO to Hasbro Consumer Products Licensing Limited (HCPL) under a transfer agreement effective from September 1, 2023.

However, from September 1, 2023 to April 17, 2024, EO still claimed to be the owner of the trademark and copyright related to Peppa Pig in complaints sent to YouTube, about Wolfoo cartoon videos infringing on the copyright of Peppa Pig cartoon videos to request YouTube to remove Wolfoo videos. Therefore, Sconnect believes that EO showed signs of dishonesty and abuse of power in the process of reporting copyright infringement of Wolfoo videos to YouTube. On YouTube's side, although Sconnect exchanged information with YouTube's copyright department (YouTube Copyright) about this situation, YouTube still removed Wolfoo videos at EO's request.

In a recent dispatch, the Department of Radio, Television and Electronic Information stated: Considering that the copyright infringement complaint between Sconnect, EO, Hasbro Consumer Products Licensing Limited (HCPL) has many complicated factors and is awaiting the Court's conclusion, the Department of Radio, Television and Electronic Information requests Google (YouTube) as an intermediary service provider to perform the following: Carefully review and verify the Sconnect issues mentioned above to ensure the legitimate rights and interests of the enterprise; Stop receiving and accepting requests to copyright Wolfoo videos that are unfounded and not within its authority; Restore Wolfoo videos and Sconnect YouTube channels that have been deleted, locked, or blocked by unfounded and not within its authority requests.

The Department of Radio, Television and Electronic Information requests that Google respond to the Department with the processing results as soon as possible.

Copyright strike is a common term in the field of digital content, meaning a copyright infringement warning from the YouTube platform when the copyright owner sends a request to YouTube to remove/delete copyrighted content. In principle, the copyright striker (complainant) must provide a legal basis for the content being copyrighted and owned by them.
