Proposal to prosecute Tran Qui Thanh and his two daughters

The Ministry of Public Security's Investigation Police Agency has just completed the supplementary investigation conclusion, transferring the case file to the People's Procuracy of the same level to propose prosecuting Mr. Tran Qui Thanh (Chairman of the Board of Directors of Tan Hiep Phat Trading and Service Company Limited) and his two daughters, Tran Uyen Phuong and Tran Ngoc Bich (both residing in Binh Thanh District, temporarily residing in Binh Duong Province) for the crime of "Abuse of trust to appropriate property".

The additional investigation concluded that, taking advantage of lending regulations and transfer contracts, Tran Qui Thanh, Tran Uyen Phuong and Tran Ngoc Bich lent money at interest rates below the level constituting a crime under Article 201 of the 2015 Penal Code but did not sign a loan contract with collateral.

Tran Qui Thanh and his son forced businesses and individuals who borrowed money to sign contracts to transfer projects, shares in projects, and real estate according to legal regulations with values ​​many times lower than the actual value of the assets.

When the property owner (borrower) was hesitant and worried about borrowing money, but had to make a transfer contract, Tran Qui Thanh and his two daughters provided information to create trust in their reputation and financial potential, signed "resale commitments", legalized loan interest with a receipt of deposit to buy back the project, real estate, promised to pay the full principal and interest and return the property.

When the property owner (borrower) completed the procedures to transfer the properties to Tran Uyen Phuong and Tran Ngoc Bich under the direction of Mr. Tran Qui Thanh, the property was quickly transferred to take control and decide on the property (real estate, capital contributions, shares).

At the same time, when the property owner (borrower) fully performed the obligation to pay the principal and interest as agreed, Mr. Thanh and his son used fraudulent tricks (giving unreasonable reasons to refuse payment, not returning the property, claiming that the property owner violated the terms of the contract and therefore lost the right to buy back...) or created reasons (forcing the property owner to pay more money, not allowing to pay each installment but forcing to pay the entire principal...) making it impossible for the property owner to perform in order to intentionally not pay and appropriate the property.

The additional investigation conclusion determined that by the above method, from January 2019 to November 2020, Mr. Tran Qui Thanh and his accomplices committed 4 acts of "Abuse of trust to appropriate property" of 4 victims, including 2 projects Minh Thanh, Nhon Thanh of Ms. Dang Thi Kim Oanh; 29 plots of land separated from plot 452 of Mr. Nguyen Van Chung; 4 plots of land of Mr. Lam Son Hoang and 2 plots of land of Mr. Nguyen Huy Dong with a total value of more than 1,048 billion VND.
