Proposal to prosecute former Minister, Head of the Government Office Mai Tien Dung

The Investigation Police Agency of the Ministry of Public Security has just completed the investigation conclusion of the case of Bribery, Receiving bribes, Abusing position and power while performing official duties that occurred in Lam Dong province and some related localities, proposing to prosecute 10 defendants.

Among them, former Minister and Head of the Government Office Mai Tien Dung was proposed to be prosecuted for the crime of Abusing position and power while performing official duties. Secretary of Lam Dong Provincial Party Committee Tran Duc Quan was proposed to be prosecuted for the crime of accepting bribes.

Mr. Nguyen Cao Tri, General Director of Saigon Dai Ninh Company, was proposed by the Ministry of Public Security to be prosecuted for the crime of Bribery.

According to the investigation conclusion, on December 30, 2010, Lam Dong Provincial People's Committee granted an Investment Certificate to Saigon Dai Ninh Company to implement the Dai Ninh Urban Area Project for Trade, Tourism and Ecological Resort (abbreviated as Dai Ninh Project) in Phu Hoi, Ninh Gia, Ta Hine and Ninh Loan communes, Duc Trong district, Lam Dong province.

The total investment capital of the project is 25,243 billion VND, the operation period is 50 years. The total land area planned for the project implementation is 3,595.45 hectares.

During the inspection of land management, use and construction investment in Lam Dong province from January 2013 to June 2018, the Government Inspectorate determined that Saigon Dai Ninh Company had many violations of the 2013 Land Law and the 2014 Investment Law in the implementation of the above project, including land reclamation and termination of project activities.

On June 12, 2020, the Government Inspectorate issued an inspection conclusion recommending that the Prime Minister assign the Lam Dong Provincial People's Committee to terminate operations and reclaim land of the Dai Ninh Project due to violations of the Land Law and Investment Law.

Upon learning that the Dai Ninh Project was being proposed to be terminated and have its land reclaimed, Nguyen Cao Tri, Chairman of the Board of Directors of Van Lang Education Investment and Management Group Joint Stock Company, agreed to buy the project back from Ms. Phan Thi Hoa by buying back shares of Saigon Dai Ninh Company held by Ms. Hoa and her relatives.

At the same time, Mr. Tri took advantage of his relationships, used money and material benefits to connect and collude with individuals holding positions and powers in state management agencies (Government Office, Government Inspectorate, Lam Dong Provincial Party Committee and People's Committee) to change, "steer", and illegally adjust the State's correct decisions in handling violations and revoking the Dai Ninh Project, with the aim of buying, selling, and transferring the project for personal gain.

The actions of officials of the state management agency helped Mr. Tri achieve his goal of changing the inspection conclusion from terminating the project's operations and reclaiming land to not reclaiming, extending the project's progress and continuing to implement the project, causing particularly serious consequences for state assets.

The entire project was later sold by Mr. Tri to Thien Vuong Real Estate Investment and Development Company Limited under Novaland Group, with an actual value of VND 27,600 billion. In addition, the State failed to reclaim 3,595.45 hectares of land and reservoir of Dai Ninh Project, causing waste of land resources.

According to the investigation conclusion, since the project was approved for extension, Saigon Dai Ninh Company did not implement the project, did not build any new items, and continued to commit 24 violations, including 4 cases of deforestation with a total forest area of 3,522m2, the volume and reserve of damaged forest products was 15,207m3; 20 cases of illegal land encroachment with a total area of 37,620m2; causing public outrage, affecting the prestige of the Party and State, and corrupting a number of leaders, cadres, and party members to the point of being prosecuted and temporarily detained.
