The Investigation Police Agency of the Ministry of Public Security has just completed the investigation conclusion of the case of Bribery, Receiving bribes, Abusing position and power while performing official duties that occurred in Lam Dong province and some localities, proposing to prosecute 10 defendants. Of which, former Minister, Head of the Government Office Mai Tien Dung was proposed to be prosecuted for the crime of Abusing position and power while performing official duties. Secretary of Lam Dong Provincial Party Committee Tran Duc Quan was proposed to be prosecuted for the crime of Receiving bribes. Former Chairman of Lam Dong Provincial People's Committee Tran Van Hiep; former Deputy Director of the Department of Inspection for Handling Complaints and Denunciations, Region 2 (Department II) - Government Inspectorate Le Quoc Khanh; former Chief Inspector of Lam Dong province Nguyen Ngoc Anh were also proposed to be prosecuted for the crime of Receiving bribes. Former Director of the Department of Monitoring Inspection Work, Handling Complaints and Denunciations, Prevention of Corruption, Smuggling, Trade Fraud and Counterfeit Goods (Department I) - Government Office Tran Bich Ngoc; Former Director of Department II, Government Inspectorate Nguyen Hong Giang was also proposed to be prosecuted for the crime of Abusing position and power while performing official duties. Tycoon Nguyen Cao Tri, General Director of Saigon Dai Ninh Company, was proposed to be prosecuted by the Ministry of Public Security for the crime of Bribery. According to the investigation conclusion, on December 30, 2010, Lam Dong Provincial People's Committee granted an investment certificate to Saigon Dai Ninh Company to implement the Dai Ninh Urban Area Project for Trade, Tourism and Ecological Resort (abbreviated as Dai Ninh Project), in Phu Hoi, Ninh Gia, Ta Hine and Ninh Loan communes, Duc Trong district, Lam Dong province. The project has a total investment capital of more than VND 25,200 billion, with an operating period of 50 years. The total land area planned for the project is nearly 3,600 hectares. During the inspection of land management, use and construction investment in Lam Dong province from January 2013 to June 2018, the Government Inspectorate determined that Saigon Dai Ninh Company had many violations of the 2013 Land Law and the 2014 Investment Law during the implementation of the project, including land reclamation and termination of project operations. On June 12, 2020, the Government Inspectorate issued an inspection conclusion recommending that the Prime Minister assign the People's Committee of Lam Dong province to terminate operations and reclaim land of the Dai Ninh project due to violations and violations of the Land Law and the Investment Law after inspection and verification. When he learned that the Dai Ninh project was being proposed to be terminated and the land reclaimed, Nguyen Cao Tri, Chairman of the Board of Directors of Van Lang Education Investment and Management Group Joint Stock Company, agreed to buy back the project from Ms. Phan Thi Hoa by buying back shares of Saigon Dai Ninh Company held by Ms. Hoa and her relatives. At the same time, taking advantage of his relationship, Mr. Tri used money and material benefits to connect and collude with individuals holding positions and powers in state management agencies (Government Office, Government Inspectorate, Lam Dong Provincial Party Committee and People's Committee), to illegally change, "steer", and adjust the State's correct decisions in handling violations and reclaiming the Dai Ninh project; with the aim of buying, selling, and transferring the project for personal gain. The actions of officials of state management agencies helped Mr. Tri achieve his goal of changing the inspection conclusion from terminating operations and reclaiming land of the project to not reclaiming, extending the progress and continuing to implement the project , causing particularly serious consequences for state assets. The entire project was then sold by Mr. Tri to Thien Vuong Real Estate Investment and Development Company Limited under Novaland Group, with an actual value of VND 27,600 billion. In addition, the State failed to reclaim nearly 3,600 hectares of land and the reservoir bed of the Dai Ninh project, causing a waste of land resources. According to the investigation conclusion, since the project was approved for extension, Saigon Dai Ninh Company has not implemented the project, has not built any new items, and has continued to allow 24 violations to occur. Of these, there were 4 cases of deforestation with a total forest area of over 3,500m2, 20 cases of illegal land encroachment with a total area of over 37,600m2; causing public outrage, affecting the prestige of the Party and State, and corrupting a number of leaders, cadres, and party members to the point of being prosecuted and temporarily detained.
