National Assembly Delegate Nguyen Van Manh proposed that individuals who volunteer to participate in fire prevention and rescue in emergency situations do not have to register with the police at the commune level where they reside.

Need policies to encourage volunteers to participate in fire prevention

This morning (November 1), discussing the draft Law on Fire Prevention, Fire Fighting and Rescue (PCCC&CHCN), National Assembly delegate Nguyen Van Manh (Vinh Phuc delegation) expressed his basic agreement with the contents of the Report on explanation, acceptance and revision of the draft law; at the same time, he said that this draft Law has demonstrated the spirit of innovation in the thinking of law-making.

Delegate Manh said that in Clause 2, Article 39, individuals wishing to participate in voluntary fire prevention and fighting and search and rescue activities must register with the police at the commune level where they reside for mobilization when required.

"So, in case of direct handling in an emergency situation, is it a condition?", Mr. Manh asked.

The Vinh Phuc delegation said that in reality, many people volunteered to participate in the search and rescue in emergency situations to save people when there were no authorities.

"Recently, a young man saved some people in a fire on Trung Kinh Street, Trung Hoa Ward, Cau Giay, Hanoi while the authorities had not yet arrived at the scene," said Mr. Manh.

From the above content, Mr. Manh said that it is necessary to add the phrase "except for volunteer fire prevention and fighting and search and rescue in emergency situations at the end of Clause 2, Article 39".

Mr. Manh also proposed to supplement state policies to encourage people to volunteer for fire prevention and fighting and to supplement fire prevention and fighting volunteers in emergency situations, and assign the Government to specify this clause in detail.

Delegate Manh also proposed to consider adding a provision stipulating that the People's Committee at the commune level is responsible for informing about the list of agencies and organizations belonging to the Fire Prevention and Rescue Force, the police agency in the commune, along with hotline numbers and contact addresses so that people know and choose the nearest place to report a fire and rescue in case of need.

Proposal to add fire protection to high-rise apartments

Delegate Vu Hong Luyen (Hung Yen delegation) proposed adding fire prevention measures to high-rise apartments because many of them have been used for a long time, have degraded infrastructure, and are prone to fire and explosion.

According to delegate Luyen, high-rise apartments are densely populated areas with high risk of fire and explosion. Many high-rise apartments were built a long time ago, and during use, the technical system was damaged or repaired, leading to the work of fire prevention, fire fighting, and rescue no longer being guaranteed.

Delegates said that there should be regulations on the traffic system leading to high-rise apartment buildings to ensure that specialized fire prevention and rescue vehicles can at least access it when a fire or explosion occurs, in order to minimize damage to people and property.

In addition, escape skills are especially important for people. In order to protect themselves and those around them, reduce casualties, and coordinate well with the rescue force when a fire or explosion occurs, delegate Luyen suggested that the drafting agency study and supplement more detailed and specific regulations on escape skills.

Accordingly, the responsibilities of those trained and fostered in fire prevention and fighting and search and rescue are supplemented.

"This is to ensure that escape skills do not stop at equipping people with theory and knowledge, but must become a natural reflex of every citizen when any fire or explosion, big or small, occurs," said Ms. Luyen.

Eliminate the regulation that fire prevention and fighting services are conditional business lines.

Mr. Le Tan Toi said that, taking into account the opinions of the National Assembly deputies, the National Assembly Standing Committee has directed the reception and careful review of the draft Law's contents with the provisions of current laws. Research, supplement and complete the draft Law to ensure comprehensiveness and compatibility between the scope of regulation and the contents of the draft Law.

Regarding fire prevention, the draft Law has separated Article 17 on Fire Prevention for Housing into 2 articles including 1 article on Fire Prevention for Housing (Article 19) and 1 article on Fire Prevention for Housing combined with production and business (Article 20).

At the same time, classify and supplement more complete and appropriate regulations for these two types; supplement full regulations on fire prevention for facilities and specifically demonstrate in Article 22 of the draft Law that has been accepted and revised.

Receive and comprehensively revise regulations on ensuring fire safety in the installation and use of electricity for daily life and production to ensure feasibility and non-overlap with current legal regulations.

Regarding the regulations on fire prevention and fighting service business, Chairman Le Tan Toi said that the National Assembly Standing Committee agreed with the above opinions that it is necessary to implement the Party's policy on "promoting the socialization of fire prevention and fighting work", creating more favorable conditions for establishments and enterprises in consulting, designing, constructing, manufacturing, importing, and trading fire prevention and fighting equipment and vehicles, and encouraging individuals and organizations to participate in fire prevention and fighting and rescue activities.

Therefore, in order to absorb the opinions of delegates and create unity in the legal system, the Standing Committee of the National Assembly directed to remove the provision that fire prevention and fighting services are a conditional business investment sector in this draft Law, and at the same time proposed to amend the Investment Law 2020.

In addition, the draft Law has absorbed, revised and supplemented regulations on financial resources and ensuring conditions for fire prevention and fighting and search and rescue activities, redesigned the transitional provisions, and separated a provision on handling facilities and constructions that do not meet fire prevention and fighting requirements and are put into use before the effective date of the Law.
