On the morning of October 31, the second day of the trial of the case of violating regulations on the use of public investment capital causing serious consequences by defendant Phan Minh Tan (former director of the Department of Science and Technology of Ho Chi Minh City) and 5 accomplices, with the indictment of the representative of the Ho Chi Minh City People's Procuracy.

Accordingly, the representative of the Ho Chi Minh City People's Procuracy proposed that the People's Court sentence former Director of the Ho Chi Minh City Department of Science and Technology Phan Minh Tan to 4-6 years in prison; Phan Thu Nga (former Head of the Science Management Department) to 3 years in prison but with a suspended sentence.
Defendant Vo Thuy Linh (former Head of Planning Department) was sentenced to 3-5 years in prison; defendants Nguyen Quoc Thai (former Deputy Head of Technology Management Department) and Chu Ba Long (former employee of Technology Management Department) were both recommended to be sentenced to 2 years in prison but given a suspended sentence.
As for defendant Khuat Duy Vinh Long (former Head of Technology Management Department), according to the representative of the Ho Chi Minh City People's Procuracy, this defendant has fled and is being wanted, this behavior shows the stubborn attitude and evasion of the law of defendant Long, so a severe punishment is needed. Therefore, the representative of the Ho Chi Minh City People's Procuracy proposed to sentence defendant Long to 10 - 12 years in prison.
Regarding civil liability, the prosecutor requested that the defendants jointly compensate for the damages caused in both projects.
According to the prosecutor, based on the case file and the results of the interrogation at the trial, there was sufficient evidence to determine that the defendants had violated regulations on the use of public investment capital, causing serious consequences. Therefore, the indictment against the defendants was the right person for the right crime.
Specifically, the Ho Chi Minh City Science and Technology Development Fund was established by the Ho Chi Minh City People's Committee on May 16, 2007, with the function of promoting the application of scientific research results and technology development, and technology transfer of Ho Chi Minh City. The management and operation apparatus consists of 6 members with Mr. Phan Minh Tan as chairman. The fund's operating agency is the Ho Chi Minh City Urban Development Investment Fund (HIFU).
From August to November 2009, taking advantage of his assigned position and authority, former Director of the Department of Science and Technology of Ho Chi Minh City Phan Minh Tan and his accomplices at this department violated state regulations on management and use of public investment in approving loans and supporting Huy Hoang Technology Investment and Development Joint Stock Company (abbreviated as Huy Hoang Company, specializing in chip manufacturing) to carry out 2 projects in violation of regulations, causing a loss of more than 22.6 billion VND to the state budget.
