On March 20, after many days of deliberation, the People's Court of Binh Phuoc province sentenced defendant Nguyen Van Sau (56 years old, former Director of CDC Binh Phuoc) to 3 years in prison for the crime of "Violating bidding regulations causing serious consequences", applied according to Clause 3, Article 222, points b, s, t, v, Clause 1, Clause 2, Article 51, Articles 38, 50, 54 of the Penal Code 2015, amended and supplemented in 2017.

The Court found the two defendants Le Thanh Bac (40 years old, Faculty of Pharmacy) and Dinh Thi Van (42 years old, Faculty of Testing) guilty of "Violating bidding regulations causing serious consequences" but were exempted from punishment; applying according to Clause 3, Article 222, points b, s, t, v, x, Clause 1, Clause 2, Article 51, Article 59, Penal Code; Clause 3, Article 5, Resolution 03/2020/ND-HDTP dated December 30, 2020 of the Council of Judges of the Supreme People's Court guiding the application of a number of provisions of the Penal Code in the trial of corruption and other crimes related to positions.
According to the indictment, in 2019, the COVID-19 situation was complicated and urgent. In order to promptly prevent and control the epidemic, Nguyen Van Sau agreed with Phan Quoc Viet, General Director of Viet A Technology Joint Stock Company, to advance the testing kits and biochemical products of this company and then legalize the contract later.
To legalize the pre-paid bid packages for test kits and biochemical reagents, from February to September 2021, Nguyen Van Sau directed Bac, Van and a number of Binh Phuoc CDC staff to legalize documents and procedures for purchasing 3 bid packages for the pre-paid goods of Viet A Company with a total value of goods of more than 41.5 billion VND.
Of which, CDC Binh Phuoc has paid Viet A Company more than 7.1 billion VND of the first phase of the bid package.
Around September 2021, Viet A Company employees paid 680 million VND in commissions to Sau, Bac and Van. Of which, Van received 275 million VND, Sau received 270 million VND and Bac received 135 million VND.
After the Investigation Agency initiated the case, the defendants returned all the money they had received. In addition, Nguyen Van Sau's family voluntarily paid 100 million VND to remedy the consequences, and Van paid 20 million VND.
According to the accusation, the actions of Sau, Bac and Van illegally interfered in bidding activities, violated legal provisions on ensuring fairness and transparency in bidding activities, causing damage to the state budget of more than 5.1 billion VND.
