On the afternoon of October 24, at the People's Court of Quang Ninh province, a representative of the People's Procuracy of Quang Ninh province presented the indictment against defendant Nguyen Thi Thanh Nhan, former Chairwoman of the Board of Directors and General Director of Tien Bo Quoc Te Joint Stock Company (AIC Company), and accomplices in the case of violations at the Quang Ninh Province Maternity and Pediatrics Hospital Project.

According to the indictment, the representative of the People's Procuracy requested the Trial Council to declare the defendant Nguyen Thi Thanh Nhan guilty of violating bidding regulations causing serious consequences, and sentence her to 10-11 years in prison.
13 other defendants were also proposed to be charged with the same crime as defendant Nhan. Specifically:
Nguyen Hong Son, former Deputy General Director of AIC Company, was proposed to be sentenced to 7-8 years in prison;
Truong Thi Xuan Loan, former Head of Project Management Board 3 of AIC Company, was proposed to be sentenced to 5-6 years in prison;
Nguyen Thi Thu Phuong, former Head of the Financial Secretary Department of AIC Company, was proposed to be sentenced to 6-7 years in prison;
Nguyen Thi Tich, former General Director of Mopha Company, was proposed to be sentenced to 3-4 years in prison;
Do Van Son, former Chief Accountant of AIC Company, was proposed to be sentenced to 30-36 months in prison;
Nguyen Thi Quyen, former General Director of Cimeico Valuation Company Limited, was proposed to be sentenced to 24-30 months in prison with a suspended sentence;
Hoang Dinh Son, former Deputy Director of the Medical Project Management Board of the Quang Ninh Provincial Department of Health, was proposed to be sentenced to 36-42 months in prison;
Nguyen Quy Thinh, former Head of the General Administration Department, Medical Project Management Board of the Department of Health of Quang Ninh province, was proposed to be sentenced to 36-42 months in prison;
Pham Ngoc Dung, former specialist of the Financial Planning Department of the Quang Ninh Department of Health, was proposed to be sentenced to 24-30 months in prison;
Tran Quoc Cong, former Director of Global Prestige Joint Stock Company, was proposed to be sentenced to 2-3 years in prison;
Nguyen Anh Dung, former General Director of Phuc Hung Company, was proposed to be sentenced to 3-4 years in prison;
Ta Hai Anh, former Head of the Labor Export Department of AIC Company, General Director of High-Tech Company, was proposed to be sentenced to 18-28 months in prison;
Cao Viet Bach, former General Director of BVA Company, was proposed to be sentenced to 18-28 months in prison.
For the two defendants who committed the crime of Lack of responsibility causing serious consequences, the People's Procuracy proposed to sentence defendant Luong Van Tam, former Director of the Management Board of Investment Projects for Medical Facilities under the Quang Ninh Department of Health, to 2-3 years in prison;
Le Thi Phu, former Deputy Head of Price Management Department of Quang Ninh Department of Finance, was proposed to be sentenced to 30-36 months in prison with a suspended sentence.

According to the indictment of the People's Procuracy, the defendants' violations in the case endangered society and violated social order and security.
The indictment stated that the defendants' violations were dangerous to society. The crime of violating bidding regulations caused serious consequences, infringing on economic management order, causing damage to the State budget. The act of lack of responsibility caused serious consequences, infringing on the correctness of State management agencies, causing damage to State assets, negatively affecting the security and social order situation.
For the group of defendants belonging to AIC Company, for economic purposes, they used tricks to approach responsible individuals of the Project Management Board of the Quang Ninh Province Maternity and Pediatrics Hospital to collude in bidding on the list, price, bidding documents, and using "blue troops" to violate bidding regulations.
The defendants of the "blue team" company, the companies affiliated with AIC Company, most of whom are employees of AIC Company, all work for a salary, in addition to showing respect and helping others like defendant Nguyen Anh Dung, they do not benefit.
As for the group of defendants belonging to the project investor, the Quang Ninh Department of Health, the defendants themselves work in the health sector and do not have in-depth expertise in the fields of bidding, asset procurement, etc., and followed instructions, so they committed violations and did not benefit.
As for the defendants of the valuation company, because they needed jobs and income to pay employees, they committed violations in the valuation related to the above project.
Considering the roles of the defendants, the People's Procuracy found that, at AIC Company, defendant Nhan was the mastermind, leader, and director of other defendants to commit bid collusion. Next, defendant Nguyen Hong Son actively assisted defendant Nhan, along with defendants Loan and Do Van Son, in violating bidding regulations, causing serious consequences, so he held the second position after defendant Nhan....

According to the indictment, during the process of participating in bidding for 6 equipment procurement packages under the Investment Project for Equipment Procurement for the Obstetrics and Pediatrics Hospital of Quang Ninh province, Ms. Nguyen Thi Thanh Nhan, as the mastermind, led the direction and directly carried out violations of bidding regulations.
In which, defendant Nhan directed Truong Thi Xuan Loan (former Head of Project Management Board 3 of AIC Company) to commit bid collusion with the investor; directed Do Van Son (former Chief Accountant of AIC Company) to commit fraud.
Nguyen Thi Thanh Nhan also assigned Nguyen Hong Son (former Deputy General Director of AIC Company) and Truong Thi Xuan Loan to direct and manage employees to create files for the "red team" and "blue team".
At the same time, the former Chairman of AIC assigned Nguyen Thi Thu Phuong to direct and operate the companies established by Ms. Nhan, direct and implement the joint venture bidding agreement, prepare bidding documents as a "blue team", so that AIC Company could participate in bidding and win 6/6 bidding packages, causing losses to the state of more than 50 billion VND.
In order for AIC Company to win the bid, there was also the help of defendants from AIC Company and related companies.
In addition, the violations in this case also include the facilitation of defendants belonging to the investor and the irresponsible behavior of defendants belonging to the state management agency during the implementation of the bidding plan.
Defendant Nguyen Thi Thanh Nhan and three other defendants are on the run and are being tried in absentia.
This is the third case in which Ms. Nhan has been criminally prosecuted while on the run. At the end of 2022, as the mastermind of the case of violating bidding regulations and accepting bribes at Dong Nai General Hospital, Ms. Nhan was sentenced to 30 years in prison by the Hanoi People's Court.
In the second case under investigation, Ms. Nhan is also accused of violating bidding at the Ho Chi Minh City Biotechnology Center.
