Chairman of the Association of Construction Contractors: Administrative procedures are like a 'maze'

The Business and Law Forum 2024 on October 9 in Hanoi attracted great attention from the business community and policy makers. Opinions at the forum focused on legal barriers that are hindering the development of the business community, especially in investment projects using land.

Mr. Phan Duc Hieu - Standing Member of the National Assembly's Economic Committee, emphasized that institutions and a favorable legal environment play an important role in promoting production and business. On the contrary, existing legal problems not only cause disadvantages for businesses but also affect the Government's social development programs, the social housing program is an example.

One of the prominent bottlenecks mentioned in the discussion session on investment projects using land is administrative procedures and site clearance.

Mr. Nguyen Quoc Hiep - Chairman of the Vietnam Association of Construction Contractors frankly pointed out that administrative procedures for investment projects using land are too cumbersome and lengthy. In fact, there are projects that require 38-40 stamps, from the stages of approving investment policies, planning, and valuation. There are planning adjustment procedures that involve many levels, departments, and branches, taking a lot of time. Out of 100 projects, all 100 projects must adjust planning at different levels.

Speakers pointed out legal problems in investment projects using land.

“Administrative procedures are extremely cumbersome and difficult, taking up to 6 months. Only when we actually do them do we see that there are too many procedures, like a maze,” the head of the Chairman of the Vietnam Association of Construction Contractors shared.

According to Mr. Hiep, there are projects where the site clearance process alone has lasted up to 14 years. This not only creates a burden for businesses but also reduces the attractiveness of the investment environment.

Along with that, the law related to real estate is being regulated by more than 15 different laws, but lacks synchronization and consistency in implementation. Although the Government has amended a number of important laws such as the Land Law, the Real Estate Business Law and the Housing Law, according to Mr. Hiep, the consultation and listening process from management agencies still has many limitations, and the reception is not close to the actual problem, so he hopes that the drafting agencies will listen more so that the law goes deeper into reality.

Ms. Pham Thi Ngoc Thuy - Director of the Office of the Private Economic Development Research Board (Board IV) also agrees with this view. In the 3 recent assessments of the Board IV on the business situation of enterprises, difficulties in administrative procedures have always been in the top 3 of the biggest difficulties that enterprises have encountered and reported. According to enterprises, complicated and overlapping administrative procedures cause many difficulties for enterprises.

Ms. Thuy recommended focusing on promoting administrative procedure reform and transparency in the progress of investment projects, because "time is money, an important opportunity and resource for businesses".

In response to these difficulties, the Government has made great efforts. Deputy Minister of Planning and Investment Nguyen Thi Bich Ngoc said that the Government has established a Steering Committee to review and resolve legal problems and has introduced many important reforms. The draft Law amending and supplementing a number of articles of the Land Law, Housing Law and Real Estate Business Law has been submitted to contribute to improving the legal environment. In addition, the Ministry of Planning and Investment is presiding over the amendment of many important laws, such as the Investment Law and the Bidding Law, to create more favorable conditions for localities and enterprises.

Delegates participating in the discussion said that the expectations from businesses do not stop at discussions, but rather practical actions after the forum so that the difficulties and obstacles of businesses can be promptly resolved, bringing the economy further in the context of globalization.

In the opening speech of the forum, Minister of Justice Nguyen Hai Ninh reiterated the direction of Prime Minister Pham Minh Chinh at the recent Government Standing Committee Conference working with enterprises: "Resolving difficulties for enterprises is contributing to solving difficulties for the economy, developing enterprises means developing the country, the spirit is that wherever there is a problem, there must be a solution, wherever there is a problem, there must be a solution, no pushing, no avoiding, no causing trouble or harassment".
