'Driver's license points should be deducted from traffic violators'

Venerable Thich Duc Thien proposed adding regulations to the law to deduct points and revoke driving licenses for drivers who violate traffic laws.

Commenting on the draft Law on Road Traffic Safety and Order during a group discussion at the National Assembly on the morning of November 10, Venerable Thich Duc Thien (Vice President and General Secretary of the Executive Council of the Vietnam Buddhist Sangha) said that since 2003, authorities have applied the measure of marking the number of road traffic violations on driver's licenses by "punching holes".

Accordingly, if the driver's license is marked for two violations, the driver must retake the test when renewing the driver's license; if marked three times, the driver's license will expire, and the driver must retake both the theory and practice tests to be issued a new license.

However, after 4 years of implementation, this regulation was abolished. The Ministry of Public Security said that punching holes on the driver's license does not show the time of violation, and the license is dirty and unsightly. In addition, punching holes can easily lead to negative consequences when drivers who have punched many holes find ways to "run" for a new license.

Venerable Thich Duc Thien said that when he took the driving test and got his driver's license in California (USA), they also applied the regulation that drivers who violate the law will have points deducted depending on the severity of the violation. When all the points are deducted from the driver's license, it will be revoked and an administrative fine will be imposed. "There needs to be a regulation on deducting points from driver's licenses in the Law on Road Traffic Safety and Order," Mr. Thien stated his opinion.

Mr. Thien also expressed concern that every year, a lot of driving licenses are issued but there are no regulations on post-test control. He gave an example of people studying and taking the driving test but then not driving for several years, or there are heavy truck drivers who not only violate alcohol concentration but also use drugs. "This is alarming. The law needs to clearly define the role and responsibility of testing and issuing driving licenses in conjunction with ensuring traffic safety and order," Venerable Thich Duc Thien suggested.

At the Quang Binh group, Major General Nguyen Tien Nam (Director of the Criminal Science Institute - Ministry of Public Security) also agreed that it is necessary to add regulations on calculating points for driving licenses to the draft law. He said that this is a management measure, not an administrative penalty. "There are currently many violations but then there is still no awareness. If points are deducted from the driving license of violators, this situation can be improved," said Mr. Nam.

Previously, when reviewing the draft Law on Road Traffic Safety and Order, the National Defense and Security Committee said that many opinions suggested adding regulations on points and deductions for driving licenses. The reason is that in the conditions of digital economy, digital society, and increasingly developing science and technology, the application of digital technology to handle traffic violations is inevitable, including calculating points and deducting points from driving licenses. Some countries have done this.

Regarding driving license testing, many opinions proposed to supplement regulations on state management after driving license testing and irregular inspections with training, testing, licensing, and re-examination of results.

Since 2020, the Ministry of Public Security has proposed the idea of ​​deducting driving license points for violators in the draft Law on Road Traffic Safety and Order. Accordingly, each driving license has 12 points, corresponding to 12 months, and drivers will have points deducted from the management system for each violation.

When all points are deducted, the driver's license is no longer valid. Drivers who want to get a new driver's license must study and take the test within at least 6 months from the date the old driver's license expires. However, in the latest draft, the drafting agency does not mention this regulation.

According to the program, the National Assembly will discuss this bill on November 24 and consider passing it at the mid-2024 session.
