However, the process of putting these laws into practice, coordinating and complementing each other requires the flexible hand of State management and careful preparation to create a comprehensive resource, maximizing the effectiveness of each law.
Deputy Director of the Hanoi Department of Planning and Investment Le Trung Hieu shared that the government and people of the capital have made great efforts in building and campaigning for the Capital Law (amended) to be passed by the National Assembly. Together with the 2024 Land Law, these will be the main policy resources to promote the investment process, construction of transport infrastructure as well as urban development in the direction of the city's transport. These laws are complementary to each other, but there are still issues that need to be adjusted when put into practice.
Lawyer Phan Thi Thanh Hien (Hanoi Bar Association) commented that to concretize the 2024 Land Law, the Government has assigned relevant ministries and branches to develop a series of circulars and decrees guiding its implementation. However, for cities with special mechanisms like Hanoi (which has a Capital Law), the promulgation and guidance on the implementation of the 2024 Land Law may have certain "channeling" issues.
“To synchronize laws and create the highest efficiency in implementation, state management agencies need to be flexible, proactive and closely coordinate throughout the process of infrastructure development and TOD projects, not making things difficult for people and businesses,” said Ms. Phan Thi Thanh Hien.
Master of Urban Management Tran Tuan Anh said that one of the biggest advantages of the 2024 Land Law is the mechanism for determining land prices that ensures market principles instead of being based on the minimum and maximum land prices of the land price framework issued by the Government as it is currently.
“This is a very important condition for infrastructure and TOD projects. It is a factor in determining the investment budget for each project, as well as the basis for calling for investment. Therefore, how to determine land prices according to the market mechanism, how to adjust them annually, and how to implement them in practice needs early, complete, and easy-to-implement instructions. Otherwise, it will cause confusion and controversy among state management agencies, investors, and people,” said Mr. Tran Tuan Anh.
Many experts believe that each new law must be put into practice in social life to be tested to clearly see its effectiveness as well as the shortcomings that need to be adjusted. The Prime Minister has requested all ministries, branches and localities to quickly deploy instructions and implement the 2024 Land Law. In the immediate future, Hanoi needs to quickly implement both the Capital Law (amended) and the 2024 Land Law in practice to have clear assessments of the effectiveness of each law and general consistency.
In particular, the work of propagating and disseminating the law to the people needs to be given due attention and promoted at all levels of government, unions and social organizations. Urban restructuring according to the TOD model will affect a large number of people. If the law is not disseminated so that people can understand and grasp it, it will be difficult to find high consensus and support. Therefore, Hanoi as well as all localities across the country need to pay more attention to propaganda work, utilizing all channels and social resources to bring the law closer to the people.
Deputy Director of the Hanoi Department of Planning and Investment Le Trung Hieu commented: “I think both laws will be most effective in the process of developing TOD urban areas in Hanoi, without any overlap. The city is making every effort to put both laws into practice as quickly as possible.”
