The program of the workshop on the afternoon of April 11 focused on discussing and listening to reports on the development, promulgation and implementation of legal policies on education related to ethnic minority and mountainous areas according to the classification of subjects prescribed in Clause 3, Article 61 of the 2013 Constitution - Current situation and recommendations; the development, promulgation and implementation of legal policies on health related to ethnic minority and mountainous areas according to the classification of subjects in Clause 1, Article 58 of the 2013 Constitution - Current situation and recommendations; the application of regional subjects in current legal documents on ethnic groups - recommendations and proposals; the implementation of policies and laws related to regulations on regional and ethnic minority subjects in some provinces and centrally run cities - current situation and recommendations and proposals; questions and answers, discussions and proposals of local representatives...
Mr. Le Nhu Xuyen - Deputy Director of the Department of Ethnic Education, Ministry of Education and Training said that the use of terms related to ethnic minority and mountainous areas as listed above in the development and implementation of policies to ensure minimum education coverage for "disadvantaged" subjects and the interconnectivity of policies, such as: Policies on universalizing education for 5-year-old preschool children, universalizing primary and secondary education; policies to support boarding students, boarding schools for ethnic minorities and high school students in areas with particularly difficult socio-economic conditions; policies to support study costs for ethnic minority students studying at universities... Thereby, the policies focus on the poor, near-poor, and ethnic minorities in areas with particularly difficult socio-economic conditions.
Mr. Le Nhu Xuyen emphasized that the demarcation of ethnic minority and mountainous areas is necessary and important, and is the basis for planning, building and promulgating socio-economic development policies for this region in order to effectively implement the Party and State's policies on ethnic affairs and ethnic policies. Therefore, the demarcation of ethnic minority and mountainous areas needs to be legalized to ensure legal validity, unity and consistency in policy making and implementation. It is necessary to promulgate criteria to identify and demarcate ethnic minority, mountainous and highland areas... (or concepts of ethnic affairs) with stability and consistency, to create favorable conditions for policy making and implementation...
Speaking at the workshop, Vice Chairman of the National Assembly's Ethnic Council Quang Van Huong also said that the system of legal documents has many types and levels, related to all aspects of political, economic and social life of the whole country in general and ethnic minorities in particular; ethnic minority areas (in terms of nature) and ethnic minorities (in terms of people) are both the scope and the subject of regulation of legal documents related to the ethnic field.
For ethnic minorities, due to the specific nature of natural and socio-economic conditions, policies in legal documents must be specifically, clearly and consistently defined in terms of scope of regulation and applicable subjects.
Mr. Quang Van Huong said that, based on the provisions of the Constitution on regions (mountainous areas; islands; ethnic minority areas; areas with particularly difficult socio-economic conditions), review the current forms of delimitation and develop a set of national delimitation criteria to serve the work of state management to ensure consistency and unity as a basis for delimitation according to each policy field, avoiding overlap and omission (such as the current delimitation of ethnic minority and mountainous areas).
Discussing the development and promulgation of regulations on a set of criteria to serve as a basis for assessing and delimiting ethnic minority and mountainous areas, and particularly disadvantaged communes, Mr. Do Quang Vinh - Deputy Head of the Ethnic Minorities Committee of Yen Bai province also said that it is necessary to delimit according to a number of key ethnic minority areas in terms of national defense and security, economy, areas in need of special preservation in terms of culture, beliefs... to facilitate investment in programs and support policies of the State.
“Specifically, the province’s ethnic minority areas should be divided into administrative units from commune and district levels upwards. There, what percentage of ethnic minorities are there, the rate of poor households, infrastructure, qualifications of commune and village officials, etc. Regarding the prescribed criteria, it is necessary to focus on investment support contents to ensure that investment support sources are targeted to the right subjects and are effective, meeting the real needs of local people,” emphasized Deputy Head of the Ethnic Minorities Committee of Yen Bai province, Do Quang Vinh.
In his concluding remarks at the Workshop, Member of the Party Central Committee, Chairman of the National Assembly's Ethnic Council Y Thanh Ha Nie Kdam said that the Workshop had 19 comments and discussions from delegates, focusing on many issues related to the Workshop's theme. The comments were basically very accurate, valuable, and focused. The delegates' comments are an important source of reference in the process of performing the tasks of law-making, law enforcement, and state management in the ethnic field of relevant agencies.
According to Chairman of the National Assembly's Council for Ethnic Minorities Y Thanh Ha Nie Kdam, it can be seen that in the practice of law-making and implementation of policies and laws on ethnic minorities, many terms and concepts are widely used and popular but have not been specifically defined in terms of content, or are only generally and unclearly regulated; the distinction between concepts is also not clear, and there are overlaps in scope and subjects. Accordingly, it has caused certain difficulties and obstacles in the implementation of tasks of a number of relevant agencies, both at the central and local levels, reducing the effectiveness and efficiency of ethnic policies.
“It can be seen that the explanation of terms and concepts related to ethnic issues and the delimitation of ethnic minority and mountainous areas is a complex and long-term task that needs to be carefully researched and have a solid scientific basis. Based on the results and values of scientific activities such as our Workshop today, competent authorities in the policy-making process will have the basis to correctly determine the content of the concepts,” emphasized Chairman of the National Assembly’s Ethnic Council Y Thanh Ha Nie Kdam.
