Need to proactively determine resettlement land prices

The city has made efforts to implement solutions to remove obstacles as well as focus on determining specific land prices in new resettlement areas so that households that are cleared or land use right transferees can soon fulfill their financial obligations and be granted land use right certificates. This needs to be continued to be focused on by agencies, units, and localities in the coming time, especially proactively determining the prices of resettlement land plots that have not yet been actually available but have been arranged on the diagram for households that are cleared.

In 2024, in the city, many households receiving resettlement land were actually slow in completing land registration procedures and those receiving resettlement land were slow in being granted land use right certificates due to lack of land prices. In this situation, departments, branches, localities and units have reviewed and proposed, and built specific land prices on roads and resettlement areas.

In the land price list adjusted by the City People's Committee according to Decision No. 59/2024/QD-UBND dated December 31, 2024 to be applied from January 1, 2025, the city added and adjusted land prices on 146 newly named roads by the end of 2023; added land prices on 15 sections, roads and roads in 4 resettlement areas at the request of the People's Committees of districts. Based on the above adjusted land prices, since the beginning of 2025, many households and resettlement land transferees have contacted the authorities to fulfill their financial obligations and carry out land registration procedures.

The City People's Committee's policy of arranging land on the map in resettlement areas without actual land has accelerated the progress of site clearance for projects, but currently, localities are facing difficulties in implementing the authorization of the City People's Committee to determine specific land prices in resettlement areas without actual land. On the other hand, in compensation and resettlement projects that last for many years, the time of compensation and resettlement arrangement is different; or in projects where the land price is compensated at the time of project implementation, while the resettlement land price is collected at the time of approval of the compensation, support and resettlement plan, leading to the land price for resettlement being higher than the price level for calculating land compensation, causing frustration among the households. In addition, the lack of land prices in resettlement areas without actual land also makes the households not know the amount of land use fees they need to pay...

According to the People's Committee of Hoa Vang district, for households arranged for resettlement in projects implemented before the effective date of the 2024 Land Law (July 1, 2024), the determination of resettlement land prices is implemented according to Official Dispatch No. 1255/UBND-DTDT dated March 3, 2020 of the City People's Committee. Thereby, the city allows households and individuals to be compensated for clearance according to the price level and land price adjustment coefficient according to the decision at any time, then the price of resettlement land will be collected according to the price level and land price adjustment coefficient at that time.

Based on the above provisions and the provisions of the 2024 Land Law, the People's Committee of Hoa Vang district has requested the City People's Committee to continue applying Official Dispatch No. 1255/UBND-DTDT to determine land prices to calculate resettlement land use fees for projects that have been and are being implemented before the effective date of the 2024 Land Law, ensuring that the land price for calculating compensation and the land price for collecting resettlement fees for cases of land acquisition in a project are the same, with the same price level so that households can promptly hand over the land and wait with peace of mind to receive the actual land. At the same time, continue to direct the removal of obstacles and difficulties in the implementation of determining land prices in resettlement areas that have not yet been implemented to speed up the progress of site clearance for projects.
