Deputy Minister of Health Do Xuan Tuyen affirmed that recently, especially after the Covid-19 pandemic, there has been a shortage of drugs and medical supplies in some units and localities, but it only happened locally, at some times and units, not all. Taking the example of a survey of Hue Central Hospital, Mr. Tuyen said that this unit affirmed that there was no shortage of drugs and medical supplies.
Deputy Minister of Health Do Xuan Tuyen said that to carry out the procurement of drugs and medical supplies at medical facilities depends on two factors: first of all, perfecting the institutions (legal documents, decrees, circulars) related to the procurement of drugs and medical supplies; Organizing implementation in localities, units, and medical facilities.
“The system is complete, but if there are problems with the implementation at localities, units, and facilities, there will not be enough medicine and medical supplies. For example, do localities allocate funds? Is the contractor selection process guaranteed to meet requirements? How are contractors selected? Once a contractor is established, will that contractor supply medicine and supplies?” - the Deputy Minister of Health analyzed.
Recognizing this problem, the Ministry of Health has proposed solutions, specifically advising the National Assembly and the Government, and coordinating with relevant Ministries to issue Circulars, Decrees, and Laws.
According to authority, in 2023, the Ministry of Health has advised the Government to submit to the National Assembly Resolution 80, which is a very meaningful Resolution on the issue of automatic drug registration numbers. Based on this content, it will be included in the draft Law on Pharmacy (amended) expected to be submitted for approval in October. If done well, administrative reform will be carried out in the issuance of drug registration renewal certificates.
In addition, Resolution 30 of the Government on continuing to implement solutions to ensure medicine and medical equipment has also removed many difficulties and obstacles. Along with that, the Ministry of Health has consulted and submitted to the National Assembly to promulgate the Law on Medical Examination and Treatment (amended) which will take effect from January 1, 2024.
The Ministry of Health has coordinated with the Ministry of Planning and Investment to submit the Law on Bidding; coordinated with the Ministry of Finance to submit the Law on Prices. After the Laws are implemented, the Ministry of Health continues to issue documents implementing the Law on Medical Examination and Treatment; coordinated with the Ministry of Planning and Investment to issue Circulars on medical examination and treatment. The Ministry also proactively issued Circulars under the Law guiding the field of procurement of medical supplies; list of centrally bidded drugs; regulations on drug bidding at medical facilities, the Ministry has provided specific instructions on the steps of development, procedures, etc.
The Ministry of Health is also coordinating with units to complete two extremely important Law projects: the Law on Pharmacy (amended) and the Law on Social Insurance (amended), expected to be submitted to the National Assembly in October 2024. If the Law on Pharmacy (amended) is passed, the Ministry will submit 5 policies, in which, basically, all policies strongly reform administrative procedures according to the Prime Minister's request to speed up the process of granting drug registration certificates. Thereby creating conditions for businesses and business establishments to import drugs.
The documents also have many outstanding new points such as: allowing the use of 1 quotation or allowing the highest quotation to be taken that is suitable for the financial capacity, expertise, and needs of the units, localities, and medical facilities (previously, there had to be 3 quotations).
In addition, bidding is assigned in urgent cases to maintain regular spending activities; The Law on Bidding is implemented in cases of emergency treatment of patients in emergency conditions according to the provisions of the Law on Medical Examination and Treatment (if any), including bidding packages for consulting services, non-consulting services, drugs, chemicals, testing supplies, medical equipment, components, accessories, vehicles, construction and installation due to sudden needs, no replacement items and mandatory use to ensure the health and life of patients; medical facilities are allowed to apply the drug purchase option to immediately purchase up to 30% of the quantity under the contract that is not yet available.
