The Ministry of Industry and Trade plans to cut and simplify many administrative procedures in the light industry sector.

The Ministry of Industry and Trade is seeking comments on the Draft Plan to reduce and simplify regulations related to the business activities of the Ministry of Industry and Trade in 2025.

In the light industry sector (alcohol, tobacco), the Ministry of Industry and Trade plans to cut and simplify 5 conditions and 11 administrative procedures.

About requirements and conditions for business investment

Requirements, conditions 1, regulations on conditions for granting a License to process tobacco materials. Abolish Clause 6, Article 12 of Decree No. 67/2013/ND-CP of the Government detailing a number of articles and measures to implement the Law on Prevention and Control of Tobacco Harms on tobacco trading, amended by Clause 3, Article 3 of Decree No. 08/2018/ND-CP of the Government.

Requirement, condition 2, amend Clause 1, Article 39 of Decree No. 67/2013/ND-CP of the Government detailing a number of articles and measures to implement the Law on Prevention and Control of Tobacco Harms on tobacco business to: "In case the License for processing tobacco materials or the License for manufacturing tobacco products that have been granted expires, organizations and individuals must submit an application for re-issuance of the license in case of continued business".

Requirements and conditions 3 on regulations on dossiers for application for a License to produce craft alcohol for business purposes. Amend the phrase "Copy of the Declaration of alcohol products in Clause 3, Article 20 of Decree No. 105/2017/ND-CP of the Government on alcohol trading (amended and supplemented in Clause 15, Article 16 of Decree No. 17/2020/ND-CP) to the phrase "Copy of self-declaration of alcohol products" to create consistency and no overlap between legal documents, creating favorable conditions for organizations and individuals to participate in administrative procedures.

Requirements, conditions 4, amending conditions for alcohol distributors. Amending Clause 4, Article 11 of Decree 105/2017/ND-CP, amended and supplemented in Clause 5, Article 16 of Decree 17/2020/ND-CP, to: “Having an alcohol distribution system in 02 or more provinces or centrally run cities (including the location of the enterprise's head office). In each province or centrally run city (outside the head office), there must be at least 01 alcohol distributor or 01 wholesale trader or 01 retail trader belonging to the enterprise's distribution system. In case an enterprise establishes a branch or business location in a province or city outside the head office to trade in alcohol, it is not necessary to have confirmation from the alcohol distributor or alcohol wholesaler or alcohol retailer”.

Requirement, condition 5, amend the provisions at Point a, Clause 5, Article 21 of Decree 105/2017/ND-CP, to: "Copy of the Contract in Principle or Confirmation Letter or Commitment to participate in the alcohol distribution system with a copy of the Alcohol Distribution License or Alcohol Wholesale License or Alcohol Retail License of the trader expected to participate in the alcohol distribution system".
