Arrest of district electricity director in Bac Kan

On the evening of March 28, information from Bac Kan Provincial Police, the Investigation Security Agency (PA09) of this province's Police has just executed an arrest warrant for temporary detention, a search warrant for the residence and workplace of Hoang Thanh Binh to investigate the act of Abusing position and power to appropriate property.

Hoang Thanh Binh (born in 1977, residing in group 8B, Phung Chi Kien ward, Bac Kan city) is the Director of Na Ri district Electricity, Bac Kan province.

According to initial investigation results, from 2021 to 2023, Hoang Thanh Binh, as Director of Na Ri District Electricity, appropriated over 300 million VND.

The case is under further investigation and clarification.

Article 356 of the 2015 Penal Code stipulates the crime of Abusing position and power while performing official duties as follows:
Anyone who, for personal gain or other personal motives, takes advantage of his/her position or power to violate public duties, causing property damage from VND 10 million to under VND 200 million or causing other damage to the interests of the State, the rights and legitimate interests of organizations and individuals, shall be subject to non-custodial reform for up to 3 years or imprisonment from 1 year to 5 years.
Committing a crime in one of the following cases shall be punishable by imprisonment from 5 to 10 years:
a) Organized;
b) Committing the crime 2 times or more;
c) Causing property damage from 200 million VND to less than 1 billion VND.
Crimes causing property damage of 1 billion VND or more shall be punished with imprisonment from 10 years to 15 years.
Offenders are also banned from holding certain positions from 1 to 5 years and may be fined from 10 million to 100 million VND.
