In Circular 29, the Ministry of Education and Training explains that extra teaching and learning is an additional teaching activity outside the prescribed time in the education plan for subjects and educational activities in the regular education program at junior high school and high school levels issued by the Ministry of Education and Training.

Article 6 of the circular also stipulates that organizations or individuals organizing extra-curricular teaching and learning activities outside of school that collect fees from students must register their business in accordance with the law, and at the same time publicize the list, location, form of teaching, fees, etc. so that students and parents know.
This makes many public school teachers understand that, in addition to performing teaching tasks according to the school program, they can open tutoring centers.
However, teachers should also note that in this circular, the Ministry of Education and Training has clearly stipulated three cases where extra teaching and extra teaching are not allowed, including: Primary school students; teachers currently teaching at schools are not allowed to teach extra classes outside of school with fees from students that the teacher is assigned by the school to teach in class; teachers at public schools are not allowed to participate in the management and operation of extra classes outside of school but can participate in extra classes outside of school.
Thus, according to regulations, from February 14, public school teachers cannot open tutoring centers outside of school.
However, teachers are allowed to participate in extra teaching at centers on the condition that they must report to the principal or director or head of the school about the subject, location, form, and time of extra teaching.
Teaching through the center, teachers' fees are cut.
On the other hand, the circular clearly states that “teachers at public schools are not allowed to participate in the management and operation of extra-curricular teaching” but does not “prohibit” teachers at non-private schools. Thus, with the new regulation, teachers at private schools can register their own business to open extra-curricular classes.
According to the principal of a high school in Hanoi, Circular 29 with many new regulations has clearly tightened the teaching and learning of extra classes both inside and outside of school. For high schools, every year the school divides classes into groups of weak - poor, average, good - excellent to review and improve right from the beginning of the school year. With this approach, the school's high school graduation exam results have achieved the general target of 100% passing the graduation exam and have a high rate of students passing the top universities.
However, with the new regulation, extra classes are only for weak students and cannot be charged, so from this February, the school will stop extra classes.
According to this principal, for extra-curricular teaching outside of school, in the past, teachers could accept to help some relatives and acquaintances organize small groups of students to study at home and collect fees according to the agreement, but with the new circular, this cannot be done.
"Teachers are worried and sad because when the regulation comes into effect, their income will decrease, while their salaries are not high. If teachers teach through a center, their expenses will be cut by 40% and the centers may also increase tuition fees to increase the amount of money paid to teachers," said the principal.
On December 30, 2024, the Ministry of Education and Training issued Circular 29 regulating the contents of extra teaching and learning with many new points that will take effect from February 14. In particular, the circular stipulates 3 cases where extra teaching and learning are not allowed; 3 cases where extra teaching and learning are allowed in schools and conditions for teachers to teach extra outside of schools to more closely manage this activity.
