Vu Thu: Removing bottlenecks in granting land use right certificates

Issuance of land use right certificates (LURCs), also known as red books, is currently an issue that attracts the attention of most households in Vu Thu district. The issuance of LURCs still has many shortcomings that cause frustration among the people. Faced with this situation, the People's Committee of Vu Thu district has taken drastic measures to remove bottlenecks in the issuance of LURCs.

Professional agencies conduct land survey to carry out procedures for granting land use right certificates to people in Trung An commune (Vu Thu).

Resolutely overcome difficulties

In January 2005, Mr. Nguyen Van Cuong's family in Lang Trung village, Trung An commune participated in and won the auction for land use rights for a plot of land of more than 80 square meters planned in the village. He has paid the land use fee according to regulations, but after 18 years, his family has not yet been granted a land use right certificate for this plot of land.

Not only Mr. Cuong, 39 other households in Trung An commune also won the auction at the same time, paid the land use fee, but so far have not been granted the land use right certificates. In recent years, these households have carried out the procedures to apply for the certificates many times but have not been granted, leading to frustration. Grasping the case through a dialogue conference with the people of Trung An commune at the end of May 2023, in June 2023, Chairman of the People's Committee of Vu Thu district directly directed the specialized units and departments of the district and the People's Committee of Trung An commune to urgently intervene, coordinate to remove obstacles, find solutions, support Mr. Cuong's family and other households to carry out the procedures, determined to complete the issuance of land use right certificates to these 40 households in September 2023.

Not only in Trung An commune, recently, hot spots and bottlenecks in granting land use right certificates in communes and towns have been paid attention to and resolved by Party committees and authorities from the district to the grassroots level. There are many difficulties in granting land use right certificates in the district such as incomplete and inconsistent cadastral data records; slow updating and adjusting land changes; many administrative procedures are required in granting land use right certificates, which are difficult to implement while coordination between district and local units is not close; The qualifications and professional skills of some grassroots professional staff, and the people's awareness of the requirements and procedures for granting land use right certificates are still limited... However, the District People's Committee and the Department of Natural Resources and Environment have issued many documents guiding localities to collect usage fees when granting land use right certificates for land allocated beyond their authority, especially Document No. 923/UBND-TNMT, dated July 13, 2022, rectifying the handling of administrative procedures in the work of granting land use right certificates. Most recently, Decision No. 4105 of the District People's Committee issued on July 14, 2023 on the establishment of the Steering Committee for the first pilot issuance of land use right certificates at grassroots levels in the district. The district has organized many specialized training courses on the work of granting land use right certificates for leaders, cadastral officers and judicial officials of communes and towns. Listening to and absorbing citizens' opinions, recently, the leaders of the District Party Committee and the District People's Committee directly directed all levels and sectors to take action to resolve a number of cases related to the issuance of land use right certificates that have existed for many years, creating trust and excitement for the people.

Positive numbers

Thanks to the synchronous and drastic participation of the Party Committee and authorities from the district to the grassroots level, the work of granting land use right certificates in Vu Thu has currently had many positive changes, clearly demonstrated by the continuous increase in the number of land use right certificates granted. If in 2021, the District People's Committee only granted 355 land use right certificates, in 2022 it granted 996 land use right certificates; in the first 6 months of 2023, over 400 land use right certificates were granted to households. In particular, the district has successfully resolved a number of cases of granting land use right certificates that have been pending for 20 years, 30 years in localities such as Tan Phong, Trung An, Song An, Nguyen Xa, Vu Doai, etc., which have been highly recognized, agreed with, and supported by the people.

The house and land in O Me 2 village, Tan Phong commune is where Mr. Tran Xuan Cong and Mrs. Tran Thi Dau have been living and working for the past half century, but they do not have any legal documents. Four years ago, he asked his children and grandchildren to complete the procedures to apply for a land use right certificate for his family, but the application was redone many times but the land use right certificate was still not issued. By March 2023, thanks to the synchronous changes and reforms from the district to the grassroots level, all difficulties were resolved, and the couple was granted a land use right certificate.

“I am very excited, so my biggest wish before returning to my ancestors, which was to get a red book, has now come true. Now my wife and I can easily exercise our right to divide and bequeath the land to 3 of our 9 children, preventing conflicts that may arise later between our children and grandchildren over the land,” Mr. Cong shared.

Continue to enter the game strongly

Mr. Nguyen Tong Thin, Vice Chairman of Vu Thu District People's Committee, said: Being granted a land use right certificate is a legitimate and practical need and directly affects the rights and land use plans of the people. The current demand for red books is very high, this is also an issue that can easily cause "hot spots" and concerns of the people. With the spirit of drastic action and determination to remove bottlenecks in the work of granting land use right certificates, Vu Thu district thoroughly grasps and enhances the sense of responsibility of cadres and civil servants in performing public duties related to the process of receiving, handling and returning results of administrative procedures in the land sector. Specialized units and localities have close and flexible coordination in guiding, consulting on records, procedures, adjusting, measuring, handling arising issues, removing obstacles... to reduce inconvenience for citizens, speed up the progress of implementation and granting land use right certificates. In case of not meeting the conditions for granting land use right certificates, the district requires specialized units to have a written response stating the reasons so that citizens can understand and not let the records backlog and prolong.

Professional staff of Tan Phong commune discussed, grasped the situation, guided and supported people to fully and promptly carry out procedures according to regulations to speed up the progress of granting land use right certificates.

Tan Phong commune has more than 3,000 households, however, up to now, over 90% of local households have not been granted land use right certificates for their land, houses and assets on their land. Currently, most households have a need to apply for land use right certificates. Doing a good job in granting land use right certificates not only protects the rights of the people but also helps the Party Committee and the government to do a good job of management, limit the occurrence of land disputes, and contribute to ensuring security and order at the grassroots level.

“With the important significance of the work of granting land use right certificates, the commune will thoroughly grasp and deploy to the villages, coordinate with relevant units of the district to vigorously implement the work of granting land use right certificates. Responding to the creative and innovative spirit of the District People's Committee in the work of granting land use right certificates, Tan Phong commune volunteered to register to pilot the issuance of land use right certificates to households in the coming time. Determining that this is a difficult and arduous task, we will participate with the highest effort" - Mr. Nguyen Huu Ngan, Chairman of Tan Phong Commune People's Committee added.

Issuing land use right certificates for the first time is a difficult and sensitive field with many problems and obstacles, but with the spirit of active and synchronous participation of all levels and sectors, Vu Thu district has been creating many positive changes in the work of issuing land use right certificates, contributing to improving land management, ensuring the legitimate rights and interests of the people, and strengthening people's trust in the Party Committee and government.

With the spirit of serving the people, we have been building a plan and are planning to soon pilot a number of models of granting land use right certificates for the first time to households in need in the locality.
