VCCI recommends information security for import-export enterprises

Commenting on the draft Decision promulgating the Regulation on the process of monitoring and managing the implementation of import-export and immigration procedures through the International Road Border Gate No. II (Kim Thanh) on the digital border gate platform of the Lao Cai Provincial Economic Zone Management Board, the Vietnam Federation of Commerce and Industry (VCCI) highly appreciated the implementation of the Digital Border Gate in Lao Cai, contributing to ensuring publicity and transparency in handling administrative procedures, improving the management and supervision capacity of state agencies; creating a multi-dimensional information channel connecting state agencies and the business community, while helping Vietnamese enterprises to export and import goods from China more conveniently.

However, to improve the draft and facilitate businesses in its application, VCCI has some important comments related to many provisions. Specifically, in Article 1, VCCI believes that Article 1 of the Draft only mentions the procedures and responsibilities of functional forces and specialized state management agencies at the International Road Border Gate No. II (Kim Thanh), but Article 2 (subjects of application) includes other agencies, organizations and individuals.

The Draft also contains specific provisions on the responsibilities of enterprises, such as registering business accounts, entering required information, initiating processes on the digital border gate platform, etc. Therefore, it is recommended to consider adjusting Article 1 to be consistent with Article 2 and other specific contents in Chapter II.

Article 2 stipulates that the subjects of application are organizations and individuals involved in import-export and immigration activities, functional forces, specialized state management agencies, and warehouse businesses at the International Road Border Gate No. II (Kim Thanh).

“So, is it understood that all import-export enterprises are required to operate on the digital border gate platform? Can enterprises that have not completed procedures on this platform carry out normal import-export activities?” – VCCI questioned.

Regarding the general principles of data management, exploitation, use and update, Clause 3, Article 3 of the draft stipulates that “Information on the digital border gate platform must be accurate, clear, continuously and promptly updated. Information is presented scientifically, easily accessible to users and can be accessed and exploited at all times”.

Clause 4 of Article 3 states: “In case of detecting organizations or individuals using information and data for the wrong purposes or in violation of regulations, affecting the rights and legitimate interests of information and data owners; the information and data management unit has the right to revoke the exploitation rights or stop sharing and connecting”.

Meanwhile, Clause 2 of Article 7 stipulates that “Functional forces at border gates are allowed to exploit and use data on the digital border gate platform according to their functions and tasks. They are responsible for the confidentiality, security and safety of the exploited information”.

On that basis, VCCI proposed to consider clearer regulations to ensure the confidentiality of business information, not all subjects can access all information on the digital border gate, thus also contributing to reducing the risk of affecting the rights and legitimate interests of information owners.
