Head of the National Assembly Delegation of Ha Giang Province Ly Thi Lan discussed the draft Law on Organization of Local Government (amended)

BHG - Continuing the working program of the 9th Extraordinary Session, on the morning of February 13, the National Assembly discussed in groups the draft Law on Government Organization (amended); the Law on Organization of Local Government (amended); and the draft Resolution of the National Assembly regulating the handling of a number of issues related to the reorganization of the state apparatus.

Participating in the discussion at group 6 were the National Assembly delegations of Ha Giang, Soc Trang, Bac Lieu, Binh Dinh provinces; Head of the National Assembly delegation of Ha Giang province Ly Thi Lan contributed many opinions to the draft Law on Organization of Local Government (amended). The delegates agreed and highly agreed with the comprehensive amendment of the law this time with the reasons, political, legal, practical bases, and viewpoints stated in the Government's submission.

Regarding the specific contents of the draft law, delegate Ly Thi Lan said that at point d, clause 3, Article 5 of the draft law, there are regulations on the standards of People's Council delegates. The delegate said that in the current period when we are implementing digital transformation, there should be specific regulations on education, degrees, and titles for People's Council delegates, because if the qualifications of People's Council delegates are guaranteed and improved, the quality of activities of People's Council delegates at all levels will be better.

Regarding the provisions on authorization to local authorities (stipulated in Article 15). The Head of the National Assembly Delegation of Ha Giang province said that Clause 1, Article 15 of the draft law stipulates: "The People's Committee, the Chairman of the People's Committee at the provincial and district levels authorize..., public service units under the People's Committee at the same level to perform their tasks and powers" is unreasonable, because the People's Committee and the Chairman of the People's Committee are state management agencies, the heads of state management agencies are assigned to perform state management functions and tasks within the local territory (provincial and district levels). As for public service units, they are only assigned the task of providing public services and serving state management . The draft Law stipulates that this is unreasonable and not in line with the expertise and profession of public service units; Accordingly, public service units will not be able to perform or will not be able to perform well the tasks and powers of state management that are authorized by the People's Committee and the Chairman of the People's Committee. Therefore, the delegate suggested that the Drafting Committee reconsider this regulation.

Also in Article 15 (Clause 5) of the draft law stipulates: "Authorized agencies, organizations, units and individuals have the right to request the authorizing agency, organization or individual to adjust the content, scope and duration of the authorization; they are not allowed to continue to authorize the tasks and powers that they have been authorized to perform". The delegate suggested that the Drafting Committee stipulate more specifically the responsibilities of the authorizing parties and the authorized parties in the law.

On the duties and powers of the People's Committee and the Chairman of the People's Committee at all levels:   Head of the delegation Ly Thi Lan said that the draft law has stipulated the tasks, powers, and delimitation of authority and power of the People's Committee and the Chairman of the People's Committee at all levels quite clearly and in detail, however, in reality, it still cannot cover all social issues. In case of arising issues that need to be approved and decided but are not included in the provisions listed in the draft law, which level will have the authority to decide? According to the delegate, this needs to clarify the authority and responsibility, to avoid the situation where when a problem arises, the agencies will push the responsibility to each other and no one dares to decide and take responsibility for their decisions. The delegate proposed that the Drafting Committee consider adding 1 more clause or 1 point to the content of the regulations on the tasks and powers of the People's Committee at each level or the Chairman of the People's Committee at each level: "Perform other tasks that are not within the tasks and powers of the People's Council .
