Head of the National Assembly Delegation of Ha Giang Province Ly Thi Lan discussed in groups about the draft Law on Organization of Local Government (amended)

Continuing the program of the 9th extraordinary session of the 15th National Assembly, on the morning of February 13, the National Assembly continued to divide into groups to discuss a number of draft laws. Discussing in group 6, delegate Ly Thi Lan, Head of the 15th National Assembly Delegation of Ha Giang province, gave her opinion on the draft Law on Organization of Local Government (Amendment).

Delegate Ly Thi Lan agreed with the reasons, political bases, viewpoints, and legal bases as stated in the Government's Proposal. At the same time, there were some comments such as: At point dk, Clause 3 , Article 5 of the draft Law, the standards for People's Council delegates are stipulated as follows: " Have cultural and professional qualifications, sufficient capacity, health, work experience and prestige to perform the duties of a delegate ... " . The delegate said: In the reality of the locality being a mountainous border province with many ethnic minorities, in recent times, it has been seen that the quality of People's Council delegates is sometimes due to the structure. Therefore, in order to improve the qualifications and quality of People's Council delegates at the provincial and district levels, it is necessary to have more specific regulations for People's Council delegates at each level regarding education, academic degrees, and titles. Clause 1, Article 15 of the draft law stipulates that "The People's Committee and the Chairman of the People's Committee at the provincial and district levels authorize..., public service units under the People's Committee at the same level to perform their tasks and powers", according to the delegate, this is unreasonable.

Clause 5 , Article 15 of the draft law stipulates: “ Authorized agencies, organizations, units and individuals have the right to request the authorizing agencies, organizations and individuals to adjust the content, scope and duration of authorization; they are not allowed to continue to authorize the tasks and powers that they have been authorized to perform”. According to the delegate, the provisions as in the draft law are not sufficient and need to be more specific. In addition, the delegate also gave opinions on the tasks and powers of the People's Committee and the Chairman of the People's Committee at all levels.
