According to the Ho Chi Minh City Department of Education and Training, tutoring is not prohibited at all but must comply with regulations. Teachers are only allowed to tutor at places that have registered their business in accordance with the law.
Circular 29/2024/TT-BGDDT regulating extra teaching and learning, effective from February 14, 2025, of the Ministry of Education and Training stipulates that public school teachers are not allowed to participate in the management and operation of extra teaching outside of school.
Teaching extra classes is not prohibited at all, but teachers must comply with regulations and can only teach extra classes at places that have registered their business in accordance with the law. This was affirmed by Mr. Ho Tan Minh, Chief of Office of the Ho Chi Minh City Department of Education and Training at a meeting to provide information on socio-economic issues jointly organized by the Propaganda and Mass Mobilization Department of the City Party Committee and the Department of Information and Communications of Ho Chi Minh City on the afternoon of February 13.
According to Mr. Ho Tan Minh, Circular 29 does not prohibit extra teaching and learning at all, but rather puts extra teaching and learning into a framework for stricter and more disciplined management. Extra learning for development and lifelong learning is necessary, but it must be determined that learning is completely voluntary.
Teachers are allowed to teach extra classes outside of school but are only allowed to teach extra classes at registered business locations (business households or tutoring centers) licensed by the Department of Planning and Investment of Ho Chi Minh City or the People's Committee of Thu Duc City, districts and towns.
In case teachers have facilities such as private houses or rooms that are qualified for individuals or organizations to register for business of teaching and learning, teachers are allowed to teach at these facilities like other centers.
As for public school teachers, the Law on Civil Servants clearly stipulates that they are not allowed to participate in the management and operation of extra-curricular teaching activities outside of school, and Circular 29 continues to reaffirm this regulation.
Another important point of Circular 29, according to Mr. Minh, is that teachers are not allowed to teach extra classes for money to students who have attended regular classes. If students have been taught regular classes, teachers must teach all the content in the regular class so that students can form and develop their self-study ability, not leave out content to teach extra classes, or put pressure on students to study extra classes for a test or an exam.
The school only organizes extra classes for 3 groups: disadvantaged students, fosters excellent students, and organizes exam review for final year students.
Mr. Ho Tan Minh said that the view of the City Department of Education is that even though they are not allowed to collect money, schools are responsible for conducting review sessions for final year students.
The Ministry of Education and Training has also issued a document requesting the People's Committees of provinces and cities across the country to direct appropriate financial support for local educational institutions in organizing review and training for students, especially final year students.
In Ho Chi Minh City, depending on local conditions, there will be a roadmap and funding for organizing review sessions for final year classes as well as training for disadvantaged students.
Regarding the question of some parents about the fact that in the past, some primary school teachers took care of students after school and tutored them while waiting for their parents to pick them up. According to the new circular, these activities are not allowed, but in reality, this is the need of many parents. Mr. Ho Tan Minh emphasized that Circular 29 clearly stipulates that teachers do not organize extra classes for primary school students, except for cases of training in arts, sports, life skills training; and do not teach extra classes for money outside of school with regular students. There will be no exceptions or leniency for violations of Circular 29 for any reason.
According to Mr. Minh, most schools now have after-school clubs for students to participate in such as sports, arts, calligraphy, and also to create conditions for parents to pick up their children late.
Mr. Minh believes that for primary school students, studying culture twice a day at school is enough. They need time to practice other skills and talents to develop comprehensively. Primary school teachers are not allowed to teach additional cultural subjects, but if teachers are capable of teaching other subjects, they can still do so according to regulations.
“The need for students to take extra classes to develop themselves is legitimate, so tutoring is also a job. If there is a need for extra classes, then tutoring can be done, but studying must be voluntary, and everything must be done according to regulations,” Mr. Minh emphasized.
