On the morning of February 12, speaking at the 9th extraordinary session, Prime Minister Pham Minh Chinh affirmed that amending a number of laws this time is to carry out a revolution in the apparatus.

Prime Minister: problems and difficulties must be solved

"This is the Party's major policy. In fact, we are almost done. We will try to finish this session and organize the new organization. In February 2025, all organizations will be completed and put into operation in March, preparing for Party congresses at all levels," said the Prime Minister.

At the same time, the Prime Minister noted that there may be problems and issues when operating, just as when buying a new car, there may be things that go smoothly but there may also be problems that need to be adjusted and resolved.

"Practice always poses problems that can be smooth and favorable, but can also be entangled and difficult, and we must solve them," said the Prime Minister.

Referring to the draft Law on Promulgation of Legal Documents, the Prime Minister emphasized the need to clearly define the agencies responsible for developing policies and procedures.

Citing the fact that the Government had to issue regulations to respond to epidemics and natural disasters, the Prime Minister said that a few years ago, the COVID-19 epidemic was like that, the Government had to issue a resolution to do it, because people were dying and it had to be done.

"The National Assembly has not been able to convene yet, so the Government, the executive body, has to do it. Like the recent Typhoon Yagi, with such heavy rain and flooding, whether or not to destroy the dam, whether or not to evacuate people, because there are tens of thousands of people evacuating at night.

Someone must decide. This must be clear and meet practical needs. What is ripe, clear, and proven effective in practice, while the issue of change needs to be delegated to the executive branch," the Prime Minister added.

The Prime Minister emphasized the need to supplement the Government's resolution as a legal document, because there are specific issues that must be dealt with immediately. "There are things that need to be resolved immediately, urgently at the necessary time, so the Government's resolution is very necessary.

This is a practical problem, a problem we have to solve. Life happens very quickly, not everything can be predicted.

We are now deeply integrated, there are many things we have to deal with that the law cannot predict.

Therefore, the law needs to provide a principled framework, leaving room for the executive branch to flexibly implement effectively. As long as there is no embezzlement, corruption, or vested interests," the Prime Minister pointed out.

He believes that it is necessary to create space for creativity and protect creators, accept risks, as in the recent resolution 57, accept risks, and not prosecute people who do not have a profit motive.

The Prime Minister also noted that the process must be quick, decisive, and must value time, individual and collective intelligence.

"To deal with individual, urgent problems, it must be personal responsibility. At that time, when it is brought up for discussion, people joke that if something they don't want to do is brought up for discussion, then if someone says they won't do it, then that's it.

That means promoting personal responsibility, but having a mechanism to protect those people," the Prime Minister added, while clarifying the need to individualize responsibility.

Revolution in law making and enactment

Deputy Chairwoman of the Judicial Committee Mai Thi Phuong Hoa (Nam Dinh) emphasized that the draft Law on Promulgation of Legal Documents is a revolution in the work of building and promulgating legal documents.

With the proposal of the new process as submitted by the Government, the time for a legal document from drafting to approval will be shortened from 22 months to 10 months, and down to 5 months if only the drafting process is carried out.

For construction and issuance, the procedure has been shortened to only about 1-2 months (a reduction of 6-8 months). "This is a huge change, meeting the rapidly changing practical requirements," said Ms. Hoa.
