Kinhtedothi - The Capital Law 2024 was passed by the 15th National Assembly at the 7th Session with many outstanding policies. Effective from January 1, 2025, the Capital Law 2024 is an institutional launch pad, removing bottlenecks for Hanoi to create momentum for breakthrough development in the Era of national growth.


Expectations for a Capital City that develops to its full potential

Hanoi is the capital, the heart of the country, not only the center of political, economic, cultural and educational activities, but also a symbol of the country's development, solidarity and prosperity. The passing of the Capital Law 2024 brings expectations of strong changes, meeting the country's desire for a capital city that develops to its full potential in the future. In recent times, in order to perfect the institutional "launch pad" for the capital to accelerate its development, the City People's Committee has stepped up coordination with ministries and branches, advising on draft decrees, resolutions and decisions guiding the implementation so that the Capital Law 2024 can soon come into effect.

Tomorrow (January 1, 2025), the Capital Law 2024 will officially take effect. The law consists of 7 chapters and 54 articles with many new regulations on policies and special mechanisms; strong decentralization and delegation of power are considered the driving force and new space for Hanoi to concentrate resources and make a strong breakthrough in development in the coming time.

As a member of the Editorial Board of the Capital Law 2024, Deputy Director of the Hanoi Department of Justice Nguyen Cong Anh said that the Law has many important new points such as the organization of urban government is stipulated in a chapter, with many contents of decentralization of power of central agencies to Hanoi City. At the same time, the Law stipulates the mechanism for investment and construction of urban railways in the direction of developing the public transport system (TOD); policies on health and social security; policies on science and technology development; rural development; regulations on controlled testing mechanism. Along with that, the Law continues to supplement existing financial mechanisms such as: mobilizing financial resources and urban development planning, traffic development...

 

Implementing the Capital Law 2024 is a particularly important task for Hanoi. The city has carefully prepared with specific plans, clear responsibilities, and progress for each agency and unit. The review and drafting of detailed documents to implement the Capital Law 2024 was proactively implemented by the City People's Committee very early. After the Law was promulgated, based on the direction of the City Party Committee, People's Council, and People's Committee, the departments, branches, and localities were directed to review each field to determine the task of drafting detailed regulations. At the same time, consider supplementing and abolishing documents, ensuring synchronization, avoiding overlaps and conflicts between the provisions of the Capital Law 2024 and the regulations issued in recent years.

“The very important content is to develop the culture of the Capital, promote the leading role of the Capital, that is the content on regional connectivity, regulations for the Capital to use its budget to support related provinces and invest in surrounding provinces... These are the contents that clearly demonstrate the policy of the Capital being the leading force of the region as well as the whole country to attract development resources” - Deputy Director of the Hanoi Department of Justice Nguyen Cong Anh informed.

Decentralization, decentralization, creating breakthrough institutions

The 2024 Capital Law has fully institutionalized the specific mechanism for the Capital to make a breakthrough; there is a clear mechanism for decentralization and delegation of authority, assigning responsibilities and giving more power so that Hanoi can decide on issues related to specific conditions. The provisions are specified in more detail in the content of assigning responsibilities and power to the Capital in the direction of priority application in the legal system. In particular, there is a separate provision regulating the application of the Capital Law (Article 4), aiming to create a breakthrough and outstanding mechanism and policy for Hanoi to develop: in case there are different provisions between the Capital Law and other laws and resolutions of the National Assembly on the same issue, the provisions of the Capital Law shall apply; in case a law or resolution of the National Assembly issued after the effective date of the Capital Law contains provisions different from the provisions of the Capital Law on the same issue that need to be applied, it is necessary to specifically stipulate the application of the law in that law or resolution...

“The Capital Law 2024 has many mechanisms and policies that are superior to the current general institutions, creating conditions for the development of the Capital. The regulations on the application of the Capital Law are completely new and different from the regulations of the Law on Promulgation of Legal Documents. The Capital Law is a special law in terms of decentralization, delegation of power, and special in terms of mechanisms and policies, different from other Laws. The Capital Law has the right to be different from other Laws and is not bound by other Laws” - Deputy Director of the Hanoi Department of Justice Nguyen Cong Anh informed.

Highly appreciating the mechanisms and policies related to the transport sector mentioned in the Capital Law 2024, Master of Urban Management Phan Truong Thanh (Hanoi Department of Transport) said that these are truly outstanding, special mechanisms and policies, strongly decentralizing and decentralizing the capital. In addition, a series of contents related to mechanisms and policies to encourage investors, especially urban development in the direction of public transport, notably the urban railway network, which were mentioned in Resolution 98/2023/QH15 but have not been specified.

 

On December 31, at the Hanoi Book Street Square Stage, the Economic & Urban Newspaper organized the Talkshow “Capital Law 2024: Realizing the Capital’s Aspiration to Rise” right before the Law officially took effect with the participation of speakers who are experts and scientists. This is a meaningful activity to disseminate to all levels, sectors and people about the new provisions of the Law, and at the same time raise awareness about the meaning and role of the Capital Law in the construction and development of the Capital.

Experts assessed that the Capital Law 2024 has focused on removing the limitations that Hanoi has been facing in the past time such as resource mobilization, investment, planning, policies for developing culture, education, health, and social security fields. In particular, there are strong solutions to help the city overcome current shortcomings in landscape, traffic, and environmental pollution. The Capital Law 2024 is a "golden opportunity", creating conditions for Hanoi to develop to new heights, improving the quality of life for the people of the capital. For the implementation of the Capital Law 2024 to be effective, it is not only the common task of the city, but also the duty of each person to contribute to the development of the capital Hanoi to become more and more "civilized - civilized - modern".

 

Speaking at a working session with the Standing Committee of the Hanoi Party Committee on November 27, General Secretary To Lam affirmed that building and developing a cultured, civilized and modern capital is the responsibility of the whole country, and first of all, it is the honor and responsibility of the Party Committee, government and people of Hanoi.
