Supplementing regulations on digital assets and artificial intelligence (AI)
Presenting the Government's proposal, Minister of Information and Communications Nguyen Manh Hung said that the bill proposes to add content on digital assets, artificial intelligence (AI) and adjust the content of "semiconductor microchips" to "semiconductors". In particular, the bill devotes a separate chapter to regulate artificial intelligence (AI) with the orientation that this is one of the most core digital technologies. Accordingly, the bill provides definitions, management and development principles, and assigns the Government to specify this content in detail. The bill also clearly states the principles of AI management and development. The bill also devotes a section on "digital assets". It clearly states that intangible assets, expressed in the form of digital data, are created, released, stored, transferred, and authenticated by digital technology in the electronic environment. Along with that, they are protected by law as property rights in accordance with the provisions of civil law, intellectual property, and other relevant laws. Crypto assets are a type of digital asset. The draft law assigns the Government to specify the types and management of digital assets and organizations providing digital asset services depending on practical conditions; measures to ensure the legitimate rights and interests of organizations and individuals; prevent, stop, limit and handle risks related to digital assets... Reviewing the draft law, Chairman of the Committee for Science, Technology and Environment Le Quang Huy said that regarding artificial intelligence (AI), some opinions said that the provisions as in the draft law are basically reasonable. However, there are opinions that comprehensive research is needed to develop a separate law on AI in Vietnam. The Committee also said that the provisions on digital assets in this law are necessary, but digital asset management is a new and complicated issue that needs to be carefully considered. The concept of digital assets is introduced into law for the first time
Giving his opinion later, National Assembly Chairman Tran Thanh Man said "this is the first time the concept of digital assets has been included in a legal document". However, he suggested carefully reviewing, considering, and regulating the concept of digital assets in the draft law, carefully reviewing the concept and ensuring that it is regulated consistently in related laws. Mr. Man also emphasized that the bill has many very new concepts, such as artificial intelligence, digital assets, encrypted assets, etc. Therefore, it is necessary to standardize and unify the understanding throughout the law; along with that, strongly promote it so that when the law is issued, people will understand and apply it easily. Vice Chairwoman of the National Assembly Nguyen Thi Thanh expressed her agreement to include the concept of digital assets in the bill. However, she said that research must be done to synchronize with the Civil Code. According to Ms. Thanh, the Civil Code only stipulates that assets are objects, money, valuable papers and property rights, but digital assets have not been classified as assets regulated here. Therefore, the draft law stipulating that digital assets are protected by law as property rights needs to be studied to be consistent with other laws in the legal system. She also suggested that further research is needed to regulate them in accordance with artificial intelligence (AI). Because this is a new field, it poses many challenges in management. The content needs to ensure a clear division of responsibilities between users, suppliers, and implementers; there are clearly defined criteria. Chairman of the Law Committee Hoang Thanh Tung also commented that this is the first time the concept of digital assets has been mentioned in the law, but if it is not mentioned, it will not be recorded, because this is a world trend. He suggested that the content must be further clarified to ensure consistency, because this content is closely linked to the Civil Code, otherwise it will lead to a disconnection between digital assets and general regulations on assets.
