This information was given at the legal session of the National Assembly Standing Committee on April 1 in Hanoi. Delegates gave their opinions on the draft Law on Prevention and Combat of Human Trafficking (amended).

Quang Nam: Supporting victims of human trafficking based on the characteristics and needs of the victims

Presenting the draft law, Minister of Public Security To Lam said that the Law on Prevention and Combat of Human Trafficking was passed by the 12th National Assembly, 9th session on March 29, 2011, and took effect from January 1, 2012. The implementation of the 2011 Law on Prevention and Combat of Human Trafficking has achieved many positive results. However, after 12 years of implementation, it has become necessary to amend and supplement this Law in order to institutionalize the Party's viewpoint on prevention and combat of human trafficking; ensure the consistency of the legal system and compatibility with international treaties; resolve existing problems, difficulties, obstacles and inadequacies in the implementation of the 2011 Law on Prevention and Combat of Human Trafficking, meeting the practical requirements of prevention and combat of human trafficking now and in the future.

The draft law adds provisions to improve the support regime for victims compared to the provisions of the current law, including: all victims who wish to return to their place of residence will be supported with travel expenses and food expenses to return to their place of residence; will be considered for support with medical examination and treatment costs; will be supported to stabilize their psychology; all victims will be provided with legal aid. When victims return to their place of residence, they will be considered for vocational training support, creating conditions for them to have a job and stabilize their lives. All victims will be supported with a one-time initial hardship allowance; if they need to borrow capital for production and business, they will be considered for a loan from the Social Policy Bank according to preferential credit policies; and will be supported with interpretation costs during their stay at social assistance facilities or victim support facilities.

Minister To Lam said: This amendment and supplement aims to ensure and protect human rights and victims' rights, in accordance with Vietnam's current and future socio-economic conditions.

The draft law supplements the concept of "human trafficking"; amends and supplements the provisions on the basis for identifying victims and the provisions on sources of documents and evidence to identify victims, along with a number of other bases for identifying victims. Supplements the concept of "persons in the process of being identified as victims" and supplements the provisions on support and protection regimes for people in the process of being identified as victims; including: support for essential needs and travel expenses; medical support; psychological support; legal aid; support for translation costs during the victim identification process.

The draft law also adds other contents to comply with the provisions of the 2013 Constitution and related laws; to comply with international treaties to which Vietnam is a member; to comply with the current practice of preventing and combating human trafficking and to meet the requirements of this work in the coming time...

Minister To Lam stated that the purpose of the law is to perfect the law on preventing and combating human trafficking, create a unified and comprehensive awareness of the work of preventing and combating human trafficking in the coming time; enhance the responsibility of individuals, families, agencies, organizations and the whole society in the work of preventing and combating human trafficking, contributing to stabilizing the security, order and social safety situation; and improve the effectiveness of state management of preventing and combating human trafficking.

The draft law is built on the viewpoint of continuing to institutionalize the Party's viewpoint on the work of preventing and combating human trafficking; concretizing the provisions of the 2013 Constitution on human rights, basic rights and obligations of citizens, ensuring consistency and synchronization with other relevant legal documents. Closely following the policies in the proposal to develop the draft Law on Prevention and Combating Human Trafficking (amended) that has been approved by competent authorities; inheriting relevant regulations, overcoming shortcomings, inadequacies, and limitations, meeting the requirements of the work of preventing and combating human trafficking now and in the future. Selectively referring to the legal experience and practices of preventing and combating human trafficking of a number of countries in the world in accordance with the practical conditions of Vietnam.
